Kruzel and Doc. #1305314 <br /> Madeline J.Kruzel Ctf.: #210913 <br /> 85 Popponesset Island Road <br /> (Map 106 Parcel 2) <br /> Mashpee,MA 02649 <br /> A Petition was filed on September 25,2017 by Owners, Paul and Madeline Kruzel <br /> requesting a Written Finding under §174-17, and relief from §174-33 (setback from water <br /> and wetlands)to allow for a deck expansion on property located in an R-3 Zoning District, <br /> (Map 106 Parcel 2),Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee, on September 29, 2017 and October 6, 2017 <br /> a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, November 8, 2017 at which time the following members of the Board of <br /> Appeals opened the hearing and were present; Acting Chairman, Ron Bonvie, Dom <br /> DeBarros and Associate Members,Norman J. Gould,and Sharon Sangeleer. <br /> Mr. Steve Cook, Cotuit Bay Design represented the home owners for this project. <br /> The house is located on Popponesset Island Road and backs up to Popponesset Creek. <br /> There is currently a deck off the master bedroom and a screen porch off the dining room <br /> with a set of stairs going down to the yard. The homeowners would like to eliminate the <br /> screen porch, and push that back about 30 inches and make it part of the existing house. <br /> They would like to remove the master bedroom deck and reconfigure the deck layout. The <br /> deck encompasses the corner of the expanding dining room all the way to the family room. <br /> They would like to add a new set of stairs going down,and align them with the lower deck. <br /> Mr. Cook pointed out the"top of the coastal bank"on the site plan in the rear part <br /> of the property. The house has a walk-out basement. There's a set of stairs that lead up to <br /> a deck to access a walkway onto the dock. The existing deck is 35 feet from the edge of <br /> the wetlands, so this project is already non-conforming as stated in the bylaw from the 50 <br /> ft.buffer to the wetlands. <br /> 1 <br />
