MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Paul M. Kruzel and Madeline J. Kruzel <br /> 85 Popponesset Island Road(Map 106 Parcel 2) <br /> Mashpee,MA 02649 <br /> FINDING-2017-58 <br /> The project would require to square off the deck, with a new set of stairs, and <br /> eliminate the deck off the master bedroom. The corner of the squared off deck would be <br /> 33 feet,the existing deck is 35 feet, and the base of the stairs is 32 feet. This will require <br /> getting 3 feet closer to the edge of the wetlands,but is at the edge of the berm.The existing <br /> deck is in rough shape and is not framed very well which is another reason to redo the deck. <br /> There's gravel and grass underneath the deck, and will not change anything in the zone <br /> between the wetlands and the house. <br /> The Board read the Board of Health, Inspection Department, and Conservation <br /> Department comments into the record. <br /> The Board confirmed that stairs were not included in setbacks, and would not be <br /> adding to the non-conformity. <br /> GENERAL CRITERIA: <br /> The subject property located at 85 Popponesset Island Road is approximately <br /> 21,800 square feet total area, and 18,300 square feet of upland area. <br /> There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> §174-33 -- Setbacks from water and wetlands: Any building or structure, <br /> exclusive of fixed or floating piers, wharves, docks, bridges or boardwalks, shall be set <br /> back at least (50')feet from any water or wetland as defined by MGL C. 131, §40. <br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday,November 8,2017,the Zoning Board of Appeals voted unanimously to issue <br /> a Written Finding with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2.
