MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Brendan M. Coughlin and Courtney Coughlin <br /> 4 Summersea Road(Map 104 Parcel 92) <br /> Mashpee,MA 02649 <br /> FINDING-2017-47 <br /> The proposal also includes a small pool and a dock complex with the dwelling.The <br /> new structure,and pool will be no closer than the existing 14.6 foot setback from the BVW. <br /> The pool is setback at 18.7 feet, and the dwelling is setback 30.2 ft. from the BVW which <br /> is an improvement over the existing 14.6 ft. setback from the wetland resource area which <br /> is referred to as BVW on the plan. Mr. Kirrane said that the only non-conformity is the <br /> distance to the wetlands which is getting better from 14.6 ft. to 18.7 ft. <br /> .The requirements under §174-17 to alter a change of a pre-existing non-conforming <br /> structure the Board will need to find that the new structure will not be substantially more <br /> detrimental to the neighborhood than what currently exists,that there is sufficient parking <br /> and setbacks that may be required by the Board. <br /> Chairman Furbush read the Conservation,Board of Health,Inspection Department <br /> and Harbormaster comments into the record. <br /> There were no more comments from the Board or audience. <br /> In view of the foregoing,the Board determined the Petitioner met the criteria for a <br /> Written Finding. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, August 23, 2017,the Zoning Board of Appeals voted unanimously to issue a <br /> Written Finding with the following conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Written <br /> Finding under Mass General Law 40A Section 6. <br /> 2.
