Coughlin and Bk. #: 29733 <br /> Courtney Coughlin Page#: 308 <br /> 4 Summersea Road <br /> (Map 104 Parcel 92) <br /> Mashpce MA 02649 <br /> A Petition was filed on July 19, 2017 by Brendan and Courtney Coughlin <br /> requesting a Written Finding under §174-17 of the Zoning Bylaws to raze and replace a <br /> single-family dwelling on property located in an R-3 Zoning District,4 Summersea Road, <br /> (Map 104 Parcel 92),Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee, on July 28,2017 and August 4, 2017 a copy <br /> of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, August 23, 2017 at which time the following members of the Board of <br /> Appeals were present at this hearing; Chairman, Jonathan Furbush, Vice Chairman, <br /> William Blaisdell,Board Members,Ron Bonvie,Dom DeBarros, and Scott Goldstein <br /> Attorney Kevin Kirrane represented the homeowners for the raze and replace <br /> project and new dock complex. Mr. Kirrane included photographs of the property, and <br /> included adjacent buildings in the neighborhood. This property is situated in the New <br /> Seabury development on a lot that consists of 11,000 sq. ft., and only has 38.18 ft. of <br /> frontage on a cul-de-sac at the end of Summersea Road.The existing home was built in the <br /> 1960's, with 3 bedrooms and serviced by a septic system. The existing structure is non- <br /> conforming given its setback from abutting wetland resource areas, and all other respects, <br /> the existing dwelling conforms to the requirements of zoning.There's a 14.6 ft.dimension <br /> from the corner of the existing deck that's attached to the building which brings it within <br /> the 50 ft. requirement of§174-33 of the bylaw. The 31 feet is the average setback of the <br /> buildings on front yard setback of the new structure will <br /> either side. So the proposed <br /> conform as does the existing structure. <br /> The new 3 bedroom dwelling will comply with the setback criteria as shown on the <br /> plan in purple. The new dwelling will be setback 16.5 ft. and 16.3 ft. from each sideline, <br /> and 31.9 ft. from the street. <br /> 1 <br />
