MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Robert J. Bortolotti,Bortolotti Construction <br /> Owners of record: L. David Scott and William J. Scott <br /> 118 Echo Road(Map 19 Parcel 9) <br /> Mashpee,MA 02649 <br /> SP-2017-45 <br /> Mr. Bortolotti said he's been leasing the property since 1995 prior to the Town <br /> paving the road, and while in operation he did not know that permitting was required. So <br /> he is asking for rightful permission to continue his business. <br /> The Building Commissioner addressed the Board and said that the applicant's <br /> request went before the Plan Review Board to discuss the business and the water runoff <br /> issues.At the time when the Town had taken over Echo Road,everyone was going through <br /> there paperwork and somehow while doing their due diligence they noticed that their <br /> paperwork had fallen through the cracks and it is just now being corrected. <br /> Mr. Goldstein read the Board of Health comments into the record. <br /> Mr. Furbush read the Inspection Department and the DPW comments into the <br /> record. <br /> Mr. Bortolotti said he will absolutely comply with all the conditions. He had no <br /> more comments. <br /> There were no more comments from the Board or audience. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Special Permit. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday, August 9, 2017, the Zoning Board of Appeals voted unanimously to issue a <br /> Special Permit under §174-25 G (13) as corrected by the Board with the following <br /> conditions; <br /> 1. The Board has determined that the applicant meets all the conditions of a Special <br /> Permit under Mass General Law 40A Section 9. <br /> 2. Plan Book 281 Page 21 —Plan approved by the Planning Board on 7-6-1974. (lot <br /> 11). <br /> 3. Conditioned on all Town Department comments read into the record; including but <br /> not limited to the Board of Health Comments and DPW comments. <br /> 2 <br />
