MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Amy P. Coghlin <br /> 56 Spoondrift Way (Map 112 Parcel 37) <br /> Mashpee, MA 02649 <br /> FINDING-2017-39 <br /> The project is to replace the non-conforming structure with a new three (3) <br /> bedroom, single-family residence pursuant to the provisions of Section 174-17. The Board <br /> is well aware that this project requires a Written Finding that the proposed new construction <br /> will not be substantially more detrimental to the neighborhood than what currently exists, <br /> and that there are sufficient setbacks to provide adequate parking to service the single- <br /> family residential use. The new structure will be situated 15.7 ft. from the northerly <br /> property line making a non-conforming condition more conforming. The structure <br /> conforms in the front at 60 ft. from the street. The deck is remaining at the same at 11 ft. <br /> from the side line. The existing principal structure is 12.6 ft. from the southerly line, and <br /> the new principal structure will be 16.0 from the side property line to the south. The actual <br /> living space will conform to the setback requirements on the southerly lot line. The overall <br /> lot coverage is slightly reduced from 19.8%to 19.3%and still within the 20%of the bylaw <br /> requirements. The septic tank is being moved to accommodate the inclusion of a garage. <br /> Attorney Kirrane concluded that the application is consistent with other structures <br /> in the neighborhood and will comply with all building code requirements. <br /> Chairman Furbush read the Board of Health and Conservation comments into the <br /> record. <br /> Mr. Bonvie read the Inspection Department comments into the record. <br /> There were no comments from the Board or audience. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Written Finding under M.G.L.40A §6. Upon motion duly made and seconded at the Public <br /> Hearings on Wednesday, July 26, 2017, the Zoning Board of Appeals voted unanimously <br /> to issue a Written Finding with the following conditions; <br /> 1.
