Town of Allay hpee <br /> 16 0,6111t,-Aleck- �kpad ;1 boh. <br /> �'��«��' �'llrxshpre, ��nssctcizi�setts.0?G��J <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2017-40 <br /> Dean Schaffer and Doc. #: 1184272 <br /> Linda Schaffer Ct£ #: 196307 <br /> 133 Popponesset Island Road <br /> (Map 112 Parcel 17) <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 13, 2017 by Dean and Linda Schaffer requesting a <br /> Written Finding under §174-17 and §174-33 to raze and replace a single-family dwelling <br /> on property located in an R-3 Zoning District, 133 Popponesset Island Road, (Map 112 <br /> Parcel 17), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on June 23,2017 and June 30, 2017 a copy of <br /> which is attached hereto and made.a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 26, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members,Ron Bonvie, Dom DeBarros, and Associate Member Norman J. Gould. <br /> Attorney Benjamin Losordo represented the applicants for the raze and replace <br /> project. He provided the Board with a narrative of the proposed project, a plot plan and <br /> house plans, and photographs of the adjacent properties. The existing house is currently 30 <br /> feet from the wetlands,and the new home will be relocated 32 feet away from the wetlands. <br /> He said that the homeowners would like to move the deck closer to Popponesset Creek. <br /> The current deck is 15 feet from the coastal bank and the applicant would like to extend <br /> the deck approximately 5 feet toward the coastal bank. The project was approved by <br /> Conservation back in 2014, and they currently approved the amended conditions with a <br /> number of concessions for the homeowners which are; moving the house back toward the <br /> street, removing part of the lawn and all the ornamental shrubs and replacing them with <br /> native species. The homeowners also agreed to restore 4,000 feet of wetlands on their <br /> property. <br /> The Board wanted to make sure that moving the deck from 20.7 to 15 ft. closer to <br /> the wetlands would not be an issue with Conservation. <br /> 1 <br />
