<br /> The Conservation Agent said that the setbacks per say are not part of their purview
<br /> and they are more concerned with disturbance of wetlands. The setback criteria is really
<br /> for the Zoning Board of Appeals.to review. The Board confirmed that the applicant has
<br /> complied with Conservation's wetlands criteria and read the comments into the record.
<br /> The Board of Health and Inspection Department comments were read into the
<br /> record.
<br /> There were no more comments from the Board or audience.
<br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a
<br /> Written Finding under M.G.L.40A§6. Upon motion duly made and seconded at the Public
<br /> Hearings on Wednesday, July 26, 2017, the Zoning Board of Appeals voted unanimously
<br /> to issue a Written Finding with the following conditions;

<br /> 3. Conditioned upon the footing and supports of the rear deck closest to Popponesset
<br /> Creek as depicted on the plan will be moved 3 ft. further away from the creek thus
<br /> creating a 3 ft. overhang of the deck, and will have to satisfy the Town Building
<br /> Inspector of the structural integrity of the deck at the time of submitting the building
<br /> application. The footings will be 18.4 from the resource area.
