Madnick and Doc.#: 1315724 <br /> Angela Madnick Ctf. 4: 212157 <br /> 27 Uncatena Road <br /> (Map 123 Parcel 65) <br /> Mashpee,MA 02649 <br /> A Petition was filed on May 17, 2017 by Michael D. and Angela Madnick <br /> requesting a Written Finding under §174-17 (extensions or alterations) and §174-33 <br /> (setback from water and wetlands), of the Zoning Bylaws to allow for installation of a 10 <br /> ft. by 10 ft. hot tub on property located in an R3 Zoning District and the Popponesset <br /> Overlay District, at 27 Uncatena Road,Map 123 Parcel 65,Mashpee,MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise,a newspaper of <br /> general circulation in the Town of Mashpee, on May 26,2017 and June 2,2017 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 28, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Member Scott Goldstein, and Associate Members,Brad Pittsley and Norman J. Gould. <br /> Mr. Jack Landers-Cauley represented the petition for the homeowner requesting a <br /> hot tub to be installed in the rear of the property that abuts Dean's Pond. The project was <br /> approved by Conservation and part of that ruling is that the homeowner provides <br /> supplemental planting. They have not started that project because they are waiting for <br /> approval by the Zoning Board. <br /> Board Member, Scott Goldstein read a letter into the record received by an abutter <br /> that resides at 31 Uncatena asking where the water will be drained and she is concerned <br /> about the run-off into Dean's Pond. <br /> Chairman Furbush read the Inspection Department comments, and that the <br /> Conservation Commission approved the application. He said that he would like to hear <br /> more from Conservation and the Board of Health in regard to the abutter letter, but they <br /> were not available when the email was received. <br /> 1 <br />
