MASHPEE ZONING BOARD OF APPEALS
DECISION FOR A WRITTEN FINDING
Michael D. and Angela Madnick
27 Uncatena Road(Map 123 Parcel 65)
Mashpee, MA 02649
FINDING-2017-33
The Board agreed to continue the hearing until July 12,2017 because they wanted
to have Conservation and Board of Health review the revised plot plan and get their revised
comments.
Public Hearings were held on the Petition at the Mashpee Town Hall on
Wednesday, July 12, 2017 at which time the following members of the Board of Appeals
were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board
Member Scott Goldstein, and Associate Members,Brad Pittsley and Norman J. Gould.
Mr. Jack Landers-Cauley returned from the last meeting to address a question from
one of the neighbors asking how the hot tub was going to be maintained. Mr. Cauley said
at the previous meeting that he would research and he came up with a design so that there
will not be a direct discharge into the septic system, the wetlands,or across the ground. He
submitted a revised plot plan and an "Action Plan"that he believes is consistent with the
recommendations of the Board of Health.
Mr. Cauley said they proposed to use a dry well that is sufficiently sized to
accommodate discharge either a portion of the hot tub or as defined in the submitted
"Action Plan"at a rate that wouldn't overburden the drywell and cause it to overflow.
Chairman Furbush read the "Action Plan" into the record that was submitted by
J.E. Landers-Cauley to the Board on July 11,2017; as follows;
Prior to the placement and utilization of the hot tub as shown on the accompanying
plan the following tasks have to be done:
*A drywell shall be installed in the location as depicted on the submitted an
approved plan.
*When it is necessary to clean or service the hot tub it will be required the hot tub
be neutralized of bleach, chorine or any other sanitizers prior to discharge of water to a
diywell, Neutralization can be accomplished by either L)Permitting the hot tub water to
rest as to neutralize by natural means or 2.) To be chemically neutralized as recommended
by the manufacture of the sanitizing agent(s).
*Discharge into the drywell shall be at a rate not to exceed the capacity of the
drjnvell.
*Any and all water from the drywell whether untreated or treated shall not be
discharged onto the surface of the ground, septic system, pond or wetland.
2
