MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Scott W. Thorp and Linda D.Thorp <br /> 62 Riverside Road(Map 119 Parcel 136) <br /> Mashpee,MA 02649 <br /> V-2017-23 <br /> Chairman Furbush read the Conservation, DPW, Board of Health comments into <br /> the record. Mr. Bonvie read the Inspection Department comments into the record. <br /> GENERAL CRITERIA: <br /> The subject property located at 62 Riverside Road is approximately 7,250 square <br /> feet. <br /> Ms. Evelyn Lynch, an abutter located at 60 Riverside Road wanted to know if the <br /> structure will be going closer to her property. Mr. Bonvie pointed out that the garage will <br /> be moving further away. <br /> VARIANCE CRITERIA: <br /> Chapter 40A: Section 10.Variances: <br /> The authority specifically finds that owing to circumstances relating to the soil <br /> conditions, shape, or topography of such land or structures and especially affecting such <br /> land or structures but not affecting generally the zoning district in which it is located, 1) a <br /> literal enforcement of the provisions of the ordinance or by-law would involve substantial <br /> hardship, financial or otherwise, to the petitioner or appellant, and that 2) desirable relief <br /> may be granted without substantial detriment to the public good and without nullifying or <br /> substantially derogating from the intent or purpose of such ordinance or by-law. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> May 24,2017,the Zoning Board of Appeals voted unanimously to issue a Variance to Scott <br /> Thorp for the front yard setback in the amount of 22.2 ft. along Clamshell Lane, the <br /> requirement is 40, and the plan as shown is 17.8. Also issuing relief for the existing <br /> structure in the amount 1.5 ft. for the side yard of the Southwest corner. The Board is not <br /> issuing relief for lot coverage.
