MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Mr. Kevin Dorney <br /> 44 Shore Drive(Map 118 Parcel 64) <br /> Mashpee,MA 02649 <br /> V-2017-26 <br /> Mr. Bonvie read an abutter letter from Winfred Reed, 59 Bluff Avenue who <br /> supports the project. <br /> Mr. Goldstein read an abutter letter from Jean Rocca and Stephen Haynes, 2 <br /> Wilsons Grove who support the project. <br /> Mr.Blaisdell read the Conservation,and Board of Health comments into the record. <br /> The Board of Health as stated that the new living space is not to be heated. <br /> Mr. Furbush read the Inspection Department comments into the record. <br /> GENERAL CRITERIA: <br /> The subject property located at 44 Shore Drive is approximately 10,927 square feet. <br /> There were no further comments from the Board. <br /> VARIANCE CRITERIA: <br /> Chapter 40A: Section 10.Variances: <br /> The authority specifically finds that owing to circumstances relating to the soil <br /> conditions, shape, or topography of such land or structures and especially affecting such <br /> land or structures but not affecting generally the zoning district in which it is located, 1) a <br /> literal enforcement of the provisions of the ordinance or by-law would involve substantial <br /> hardship, financial or otherwise, to the petitioner or appellant, and that 2) desirable relief <br /> may be granted without substantial detriment to the public good and without nullifying or <br /> substantially derogating from the intent or purpose of such ordinance or by-law. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> May 24, 2017, the Zoning Board of Appeals voted unanimously to issue a Variance to <br /> Kevin Dorney of 44 Shore Drive of the front yard setback located from Bluff Avenue in <br /> the amount of 6.3 ft., The required distance is 25 ft., and will have 18.7 ft., to allow for <br /> construction of a deck and conversion of the attached garage into a three season porch on <br /> property located in an R-3 Zoning District and the Popponesset Overlay District,Map 118 <br /> Parcel 64,Mashpee,MA. <br /> 2 <br />
