Jalbert, Trustees of Ctf. #: 211654 <br /> the Jalbert Realty Trust I Lot#: 1792 <br /> 43 Monahansett Road Plan#: 11408.213 <br /> (Map 123 Parcel 103) <br /> Mashpee, MA 02649 <br /> A Petition was filed on December 7,2016 by Paul A.Jalbert and Cynthia A.Jalbert, <br /> Trustees, requesting a Variance under §174-33: setbacks from water and wetlands of the <br /> Zoning Bylaws to allow for construction of a deck on property located in an R-3 Zoning <br /> District, 43 Monahansett Road, Map 123 Parcel 103, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on December 16, 2016 and December 23, <br /> 2016 a copy of which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 11, 2017 at which time the following members of the Board of <br /> Appeals were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, <br /> Board Member, Dom DeBarros and Associate Members, Brad Pittsley and Norman J. <br /> Gould. Also present was Building Commissioner, Michael Mendoza. <br /> Cynthia Jalbert represented herself for the deck project. She said her house is <br /> currently under construction for a second floor addition and garage. There was a land swap <br /> done on the adjacent property that was approved by the Planning Board,so that her property <br /> and the adjacent property would both have conforming lots. Conservation approved the <br /> deck, but the applicant was told to file with the ZBA because the deck is within the 50 ft. <br /> buffer of the water and wetlands. The new deck will be built in the same area as the old <br /> deck,and will extend toward the back of the garage.The property is also in the Popponesset <br /> Overly District. <br /> Mr. Furbush read the comments from.
