MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Paul A. Jalbert and Cynthia A. Jalbert, Trustees <br /> 43 Monahansett Road (Map 123 Parcel 103) <br /> Mashpee, MA 02649 <br /> V-2017-04 <br /> Mr. Mendoza, Building Commissioner suggested that the applicant contact the <br /> Board of Health to confirm that they have approved the building plans, and that they will <br /> need to see the plans for the deck prior to issuing the building permit. <br /> GENERAL CRITERIA: <br /> The subject property located at 43 Monahansett Road is approximately 12,689 <br /> square feet. <br /> There were no abutters present. <br /> VARIANCE CRITERIA: <br /> §174-33. Setback from water and wetlands Any building or structure, exclusive <br /> of fixed or floating piers, wharves, docks, bridges or boardwalks, shall be set back at least <br /> fifty (50) feet from any water or wetland as defined by MGL C. 131, §40. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance under §174-33. Setback from water and wetlands. Upon motion duly made and <br /> seconded at the Public Hearings on Wednesday, January 11, 2017, the Zoning Board of <br /> Appeals voted unanimously to issue a Variance for the deck based on the following; A plot <br /> plan for 43 Monahansett Road,Mashpee, MA, Prepared for: Cynthia Jalbert, Prepared by: <br /> JC Engineering Inc., 2854 Cranberry Hwy, East Wareham, MA 02538, Scale: 1" = 10', <br /> July 7, 2016, Rev: August 5, 2016, Rev: November 3, 2016, JCE #2568-1. Also is <br /> conditioned upon all department comments read into the record, and the Board of Health <br /> requirement to review the building plans of the deck prior to issuance of a building permit. <br /> 2 <br />
