Barber and Donna Barber Bk#: 15553 <br /> 1.66 Wheeler Road Page#: 259 <br /> (Map 49 Parcel 9) <br /> Mashpee, MA 02649 <br /> A Petition was filed on March 9, 2017 by Owners, Stephen and Donna Barber <br /> requesting a Variance from the front yard setback under §174-31 (Land Space <br /> Requirements)of the Zoning Bylaws to allow for construction of a detached two car garage <br /> on property located in an R-5 Zoning District, 166 Wheeler Road, (Map 49 Parcel 9), <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A.Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on March 17 and March 24, 2017 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpec Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §10 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday,April 12, 2017 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, and Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner, Michael Mendoza, <br /> Mr. Collins O'Connor represented the homeowners for this project. Mr. O'Connor <br /> said the Board approved a sideline variance back last November for the garage. He said it <br /> was staked out and ready for excavation when the homeowners noticed the design was <br /> closer to the house than they wanted,and therefore would like to move it 8 ft. closer toward <br /> the street. He said the distance between the house and garage is about 18 ft., and the <br /> previous design it was 10 ft. Mr. O'Connor does not feel that it changes the character in <br /> the neighborhood. <br /> Mr. Bonvie read Conservation Comments and Board of Health comments into the <br /> record. Mr. Furbush read the Inspection Department comments into the record. <br /> There were no abutters present. <br /> 1 <br />
