Board of Appeals Minutes_..November 18, 1998 4 <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera, <br /> David Sanicki of Cape& Islands Engineering represented the applicants stating that the <br /> application was originally heard by the Board of Appeals at the Public Hearings on <br /> October 14, 1998. The applicant had failed to file for permission to construct an in-law <br /> apartment; and for that reason the Board voted to continue the application. <br /> The Board of Health has approved the relocation of the septic system, The Conservation <br /> Commission has approved the project. Mr. ,Sanicki submitted new building plans with <br /> revisions that include lowering the roof line, closing in two openings and installing <br /> windows. He stated that a breezeway will be constructed to connect to the two-car <br /> garage with another connecting breezeway to the in-law apartment. The lot coverage will <br /> be 6,8%. The locus and fire hydrant were also included in the new plans: <br /> Mr. Nelson expressed concern with fire apparatus having access to the home. Mr. West <br /> informed the Board that the abutters have all agreed to contribute toward upgrading and <br /> resurfacing the condition of the road. <br /> No comments were received from abutters. <br /> Mr. Guerrera moved to grant the Special Permit with the following conditions: <br /> • findings 1-4. <br /> • that the in-law apartment shall be used for family members only. <br /> • upon sale of the property, the new owners must abide by the conditions set <br /> down at this meeting—that the in-law apartment remain in use by family <br /> members only and not for rental purposes. <br /> • in compliance with §174-32 of the zoning by-laws, the applicant shall <br /> maintain the road from Monomoscoy Road to the hydrant on Russell Road <br /> with a minimum width of 14 feet and a minimum vertical clearance of 13 <br /> feet six inches. <br /> Mr, Nelson seconded.
