Board of Appeals Minutes--November 18, 1995 3 <br /> Mike's Service Station--Requests a Special Permit under Section 174-17 of the Zoning <br /> By-laws for permission to replace and construct an island canopy to an existing non- <br /> conforming structure on property located in an R-5 zoning district at 135 Main Street <br /> (Map 37 Block 58)Mashpee, MA. (Owner of record: S. Joseph DiMaggio.) <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. Gary Bourne of Bourne Petroleum represented the applicant's proposal to remove an <br /> existing canopy and install a new canopy at Mike's Service Station. The project will <br /> involve putting in a 24 by 30-foot canopy with two piers. The lighting will be recessed <br /> inside the canopy. He indicated that the canopy preserves the pumps and shields the <br /> attendants from the inclement weather. He informed the Board that the applicant is in the <br /> process of installing new fuel lines. The new tanks have been installed underground. <br /> Mr. Nelson questioned where the car and truck rental parking is located. Mr. DiMaggio <br /> replied that no parking space has been lost with the proposal and the pump island is <br /> extended and larger. <br /> Mr. Hauck recommended that the Special permit be granted with a condition regarding <br /> the lighting be contained below the canopy and should not shine toward the residential <br /> neighborhood. <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant the Special Permit, subject to the following: <br /> compliance with plan titled"Proposed Gas Station Renovations located in <br /> Mashpee, Mass. Prepared for S. Joseph DiMaggio, Plan No. 082498, dated <br /> August 24, 1998". <br /> • lighting shall be recessed into the deck of the canopy so that it does not extend <br /> below the lip of the structure. <br /> • if complaints are received from neighbors, lighting will be adjusted <br /> accordingly. <br /> i <br /> • criteria for Special Permits <br /> • findings I (canopy conforms to setback requirements), 3 (slight increase in lot <br /> coverage, but under 201/6), 5. <br /> Mr. Guerrera seconded.
