Webster—Requests a Variance from Sections 174-21 and 174-31 of the Zoning <br /> By-laws for permission to vary the lot size on non-conforming lots with a non- <br /> conforming structure on properties located in an R-3 zoning district at 407 and 409 <br /> Monomoscoy Road (Map 124 Block 62 and Map 124 Block 63),Mashpee, MA, (Owner <br /> of record of 407 Monomoscoy Road: John A. Moore, Jr.) <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> Mrs. Webster and Mr. Moore attended the meeting. David Sanicki of Cape& Islands <br /> Engineering represented the applicant referring to the plan in which Mr. Moore owns <br /> Lots 2 and 3 and Mr. Webster owns Lot 1. Mr, Webster owns a shed that is over the lot <br /> line, Maintaining present frontage on the lots,the owners have entered an agreement for <br /> Mr, Webster to purchase from Mr. Moore a 25-foot wide strip of land. Lot 2 (as it <br /> appears on the submitted plan)will be taken from Lot 3 and conveyed to Lot 1. Lot 3 <br /> will drop from 41,400 square feet to 3 5,3 50 square feet; and Lot 2 will increase from <br /> 16,750 square feet to 22,800 square feet with the transfer of land, Non-conforming lot <br /> frontages and lot sizes necessitate the need for relief from the frontage requirements. Mr. <br /> Sanicki further stated that this is a Land Court situation that will need Planning Board <br /> approval as well. He added that all the lots on Monomoscoy Road are similar in nature. <br /> Mr. Regan referred to a request from an abutter,Ms. Nancy Cook,who asked for <br /> information on the application to be faxed to her. No other comments were received <br /> from abutters. <br /> Mr. Nelson moved to grant a Variance for each Lot (407 and 409 Monomoscoy Road) <br /> according to "Plan of Land Located in Mashpee, Mass. Prepared for Robert Webster, <br /> being Plan#100198, dated October 1, 1998". Subject to Criteria 1-4 and Findings 1, <br /> Mr. Guerrera seconded, All agreed. <br /> Donald M. &Linda N._Rose—Request a Special Permit under Section 174-25.I.9 of the <br /> Zoning By-laws for permission to construct a pier, ramp and float in Wakeby Pond on <br /> property located in an R-5 zoning district at 48 Cove Road (Map 6 Block 4)Mashpee, <br /> MA. <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. Rose represented his application to build a pier, ramp and float in Wakeby Pond. He <br /> remarked that there is a steep drop from his property to the proposed ramp. The proposal <br /> is for the dock to be seasonally removed. The Conservation Commission has reviewed <br /> the project. Mr. Regan noted that Sandwich abutters were informed and that a letter from <br /> DEP was received noting Mr. Rose's application No comments were received from <br /> abutters. <br /> Mr. Nelson moved to grant the Special Permit, subject to Criteria for a dock and Findings <br /> 1, 2(Conservation Commission), 4, 5. <br /> Mr. Guerrera seconded.
