Board of Appeals Minutes—October 28, 1998 7 <br /> A seven-foot stockade fence will be installed. Shrubbery at the entrance will be no <br /> higher than four feet in height. <br /> A $7,000 landscape performance check will be required. <br /> Mr. Nelson questioned when the building will be finalized. Mr. Berish estimated it <br /> would be in March, <br /> Mr. Berish informed the Board that he has one tenant, a bakery shop, that will be renting <br /> space from him. He stated that he will aggressively market and advertise for more <br /> tenants once he receives his building permits. <br /> Mr, Nelson moved to grant the Variance, subject to criteria 1, 2, 3, 4 and findings 3 (the <br /> lot could not be used for commercial purposes)and that there are roads on four sides of <br /> the property. The property constitutes an entire block of land with sufficient frontage. <br /> The Variance will be conditioned by the following: <br /> ® Massasoit Avenue from Nathan Ellis Highway to beyond the point of entry to <br /> the Old Brickyard complex shall be constructed with a paving width of 24 feet <br /> centered on a layout to a specification approved the Director of the <br /> Department of Public Works for the Town of Mashpee. <br /> • No occupancy permits shall be issued until the base coat for the road has been <br /> constructed and approved by the Director of the Department of Public Works. <br /> * The paving of Old Brickyard Road shall be widened to 24 feet from Nathan <br /> Ellis Highway to the point of entry to the Old Brickyard complex. <br /> • There shall be a performance bond for landscaping of$7,000, <br /> O The fencing on the rear of the property shall be a 7-foot high stockade fence <br /> with the good side facing towards the street, <br /> ® No shrubbery higher than four feet shall be permitted within a distance of <br /> eight feet from the entrances to the parking lot. <br /> • Compliance with the signed plan from Design Review that will cover the <br /> lighting, berm, traffic, parking, right-turn only signs. <br /> Mr. Dorgan seconded.
