Board of Appeals Minutes -May 27, 1998 <br /> 4. <br /> Willowbend .Develo ment Corp. -Requests a Variance from Section 174-31 of the Zoning By- <br /> laws for permission to vary the minimum lot size requirement on the following lots located <br /> R-3 zoning district. The lots are shown as Lots 1 to 3 5 on an Approval Not Required in to <br /> February 4, 1998 and the Shoestring Bay Estates Subdivision plan dated November 20, 1985, <br /> Members sitting: E. Govoni, C. Hawver, R. Nelson <br /> John McElhiney of Willowbend represented the applicants and informed the Board that the new <br /> ANR plan and the overlay plan which shows the original subdivision have been recorded. He said <br /> they have met the 150 foot frontage of current zoning but lot sizes do not meet zoning, H <br /> they have reduced number of lots from 42 to 38 but some of the lots are now subject o the by- <br /> law <br /> requiring that wetland areas be excluded. <br /> He explained that he would need a Modification to the Willowbend ,Special Permit from the <br /> Planning Board in order to access the lots within Willowbend land. He said they will be doing <br /> screening and landscaping and adding municipal water. They have met with the neighborhood <br /> association and will be connecting some of the abutters. He said they will be using denitrifying <br /> septic systems to limit nitrate loading and will be working to improve drainage on Simons <br /> Narrows Road. <br /> There was discussion of the maximum period for exercising variances and he asked the B <br /> consider adding to the decisions that the variances would be considered exercised with the to <br /> installation of municipal water lines through the subdivision and completion of the connection <br /> road through to Willowbend. <br /> Brad Caflyn, a resident of Mashpee, asked if the subdivision could be added to the Willowbend <br /> septic treatment plant. Mr. McElhiney said that state policy allows plants to be used only for <br /> condominium ownership. Wayne Duchemin of the Bay Ridge Association stated that the <br /> Association is in favor of the application. <br /> Mr. Govoni moved to take the application under advisement. Ms. Hawver seconded <br /> A11 aed. <br /> gre <br /> Craig Lynch - Attorney Jeremy Carter said that a swimming pool has been planned 10 feet from <br /> the property line as approved by Conservation. The original structure was 5 feet from <br /> property line so that this is an improvement and was approved by Bill Hauck. The S <br /> ot specify <br /> for the dwelling stated that the setback will be 15 feet but Attorney Carter said it did p ecial Per mit <br /> 15 feet was necessary. The Board agreed that it was not necessary to modify the Special Permit,P rnrt. <br /> D. J. Donahue - The Board agreed to release the landscape bond. Mr. Hauck said the <br /> landscaping did not conform to the approved plan but Mr, Govoni stated it was better. <br /> Meeting adjourned. Minutes typed from tapes. <br />
