Board of Appeals Minutes -May 13, 1998 <br /> 4. <br /> Members sitting: C. Hawver, J. Dorgan, R. Nelson <br /> Attorney Kevin Kirrane represented the applicant. He explained that the applicant <br /> requires a Variance of 7 feet from the front setback in order to meet the 50 foot setback <br /> from the wetlands. Mr, Hauck explained that the zoning in the area originally required a <br /> 20 foot front setback and a 10 foot side setback but that he is now requiring a 30 foot <br /> front setback. He said the shape, size and topography of the lot create a hardship in the <br /> use of the lot. An abutter asked to see the plan but had no objections. <br /> Mr. Nelson moved to grant the Variance of 7 feet to allow a 23 foot front line setback. <br /> He found that the shape and topography with the unusual contours affected this lot and <br /> not the district and that the Iot has been maintained as a separate lot and is subject to <br /> betterments. Mr. Dorgan seconded. All agreed. <br /> Will <br /> Members sitting: E. Govoni, C. Hawver, R. Nelson <br /> Mr. Govoni stated that Willowbend has requested an extension in the hearing calendar to <br /> July 15, 1998. Mr, Govoni moved to grant the extension, Cheryl Hawver seconded. Mr. <br /> Nelson made the vote unanimous, <br /> Dunkin' Donuts - Requests a Special Permit under Sections 174-25.E.1, 174-25.E.2 and <br /> 174-25.H.6 of the Zoning By-laws for a donut and coffee shop with an accessory drive <br /> through window and one retail store on property located in a C-2 zoning district at 401 <br /> Main St. (Map 28, Block 10)Mashpee, MA. (Owner of record: Amaneio S. Correia). <br /> Members sitting; E. Govoni, J. Regan, M. Makunas <br /> Mr. Kirrane reviewed the application and the use of a consultant for a traffic study to be <br /> prepared for the Board at the applicant's expense. He stated that the applicant has <br /> revised his plans to conform to the recommendations in the study by Bruce Campbell <br /> Associates. The building design has not been changed but they will move the drive- <br /> through window forward as suggested in the plan. Referencing page 10 of the report, Mr. <br /> Kirrane said they have provided for: <br /> 1. adequate space for an eight vehicle queue <br /> 2. two driveways servicing the site -- one driveway in and one driveway out <br /> 3, angular parking stalls on each side of the building <br /> 4. there is acceptable turning radius for on-site delivery trucks <br /> 5. the internal driveway on the east side adjacent to the directional signs has been <br /> narrowed <br /> 6. parking spaces on south side of the building have been angled <br /> 7. agree to a condition on pavement markings suggested in the report. <br />
