Board of Appeals Minutes - April 22, 1998 <br /> 3. <br /> Michael Barrows, a neighbor, stated his concern on the increases in traffic. Mr. Elhinney <br /> said they would try to have access to the subject lots through Willowbend and would <br /> work with the neighbors to improve conditions. Nancy Barrows said there are three day <br /> care centers in the area and they do not want increases in traffic. <br /> Mr. Nelson stated that the plans should indicate the derivation of the lots andMr. Govo <br /> said that they should have shown the original subdivision by dotted lines on thni <br /> e r. tan, <br /> Mr. Guerrera said they should have shown a base line on the plans. Mr. Nelson stated that <br /> they needed a reference plan. Mr. Besse suggested they would provide a reference Ian <br /> and Mr. Elhinney asked if they should record the plan. Bill that stated that he has the <br /> limit of 20%growth and that variances lapse after 1 year with a 6 month extension. Mr. <br /> Elhinney questioned if the variance was in effect if the lots were sold. There was <br /> discussion of renewal of variances on Sunset Strip and James Circle. IVIr, Govoni <br /> questioned if the variance should be given for the entire subdivision but Bill Hauck said <br /> this would apply only for Special permits for definitive subdivisions from the Planning <br /> Board, Mr. Hauck said this was beyond written zoning and would require legal o inions <br /> if a subdivision could have a variance, p <br /> Mr. Elhinney said there is conflict between the phasing by-law 1 <br /> variance. Mr. Hauck suggestedp g Yaw and the time limit of the <br /> Town Counsel attend a meeting. Mr, Govoni suggested <br /> r an extension in the hearing calendar so that hearings can be continued. Mr. Elhinney said <br /> j <br /> the proposed deed includes identification of the lots in the subdivision plan and referencing <br /> the new lots on the ANR plan. He suggested that Charles Rowley, the Planning Board <br /> engineer, meet with the board. Mr. Elhinney said they would be ha <br /> ppy to extension but would have to check the time restrictions on the Bu and Sell.. a 60-day <br /> Y <br /> Mr. Govoni stated that the Board shouldget an opinion on the fife of the Variance. Ms. <br /> Hawver moved to continue to <br /> May 27 <br /> Mr. <br /> . <br /> . Nelson els <br /> on s <br /> ecn <br /> nded. All agreed. <br /> Wendy Long -Ms. Hawver moved to allow withdrawal. Mr. Guerrera seconded.
