Perez- Requests a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the side and rear setback requirements to allow the construction of a <br /> swimming pool on property located in an R-3 zoning district at 13 Wheelhouse Lane (Map <br /> 120, Block 169) Mashpee,MA. The proposed pool would be located 9.48 feet from the <br /> side lot line and 14.17 feet from the rear lot line. (Owner of record: Myrna A. Perez). <br /> Members sitting: C. Hawver, I Regan, R. Nelson <br /> Engineer Michael Perez moved to withdraw the application without prejudice. Mr. <br /> Nelson moved to grant the withdrawal without prejudice, Ms. Hawver seconded. All <br /> agreed. An abutter asked to submit a letter of objection for the file. A representative of <br /> the Little Neck Bay Association asked if the applicant could reapply and was told that they <br /> could, <br /> Robert M. and Shirle Bruneau -Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the lot size and frontage requirements on property located <br /> in an R-5 zoning district at 310 Main St. (Map 36, Block 35A)Mashpee, MA. <br /> Members sitting: I Regan, C. Hawver, M. Makunas <br /> Attorney Robert Mills represented the applicant. He said the parcel had received a <br /> ' Variance in 1987 which has expired. He said zoning has changed in the area and this lot is <br /> as large or larger than those in the area, He stated that a variance is required for frontage <br /> and lot size. <br /> Mr. Mills explained that there are two separate deeds for this and an adjoining property <br /> and he presented tax bills showing the separation of the lots, Mr. Makunas stated that the <br /> findings of the 1987 variance were applicable to this situation and that the application be <br /> amended to reflect that the subject property was Map 36,Block 55. <br /> Ms. Hawver moved to grant the Variance of 25 feet in frontage and a Variance in tot size <br /> I of 36,440 square feet to allow 125 foot frontage and 43,560 square feet in lot size.The <br /> i Board determined that without relief it could not be used for a residence and was subject <br /> to betterments and that the hardship was not self-imposed, Mr. Makunas seconded. All <br /> agreed. <br />
