I <br /> Board of Appeals Minutes - April 8, 1998 5. <br /> as raw land. Mr. Makunas moved to deny without prejudice due to lack of information <br /> supplied to the board. Mr. Nelson seconded. Mr. Regan abstained. The motion carried, <br /> Mr. Nelson said the proposal was for two new structures in a single family zone. <br /> Kenneth E. Litvack - requests a Variance from Sections 174-31 and 174-33 of the Zoning <br /> By-laws for permission to vary the front setback, lot coverage and setback from wetlands <br /> requirements to allow the construction of a garage with a 20 foot front setback, a 9.1 foot <br /> setback from Popponesset Creek and 25%lot coverage for property located in an R-3 <br /> zoning district at 11 Taff ail Way(Map 106, Block 7) Mashpee, MA, <br /> Kenneth E. Litvack- requests a Special Permit under Section 174-17 of the Zoning By- <br /> laws to allow the expansion of a non-conforming home with the addition of a garage/bome <br /> office on property located in an R•3 zoning district at 11 Taff-rail Way(Map 106, Block 7) <br /> Mashpee, MA. <br /> Members present: I Regan, R. Nelson, I Dorgan, M. Makunas, R. Guerrera <br /> Michael Grotzke asked if the Board would reopen the discussion. Mr. Nelson moved to <br /> reopen the hearing. Mr. Dorgan seconded. Mr. Regan made the vote unanimous. <br /> Mr. Grotzke said there were architectural considerations which made the Board's <br /> requested relocation of the garage undesirable. The architect reviewed the site conditions <br /> and said garage placement was done to protect a view from the second floor office. He <br /> reviewed the extensive landscape plan. He said to rotate the garage would be a detriment <br /> to the project. <br /> Mr. Makunas stated that the applicant had not met any criteria for a hardship or for the <br /> granting of a Variance. Mr. Regan moved to take it under advisement. Mr. Dorgan <br /> seconded. Mr. Makunas made the vote <br /> unanimous,s. Mr <br /> . Regan <br /> stated d that the hearing is <br /> now closed to testimony. <br /> Minutes - Mr. Nelson moved to accept Minutes of March 11, 1998. Mr. Makunas <br /> seconded. All agreed. Mr. Nelson stated there there were corrections needed on the <br /> minutes of the meeting of March 25 on Merry Meadows Enterprises which did not <br /> explain that the Board approved the earlier plan. On the Dunkin' Donuts Mr, Makunas <br /> asked that his vote for denial be recorded. . <br /> Mr. Nelson asked if Board Members would attend the Planning Board meeting on April <br /> 15. He reviewed proposed zoning amendments to make the ZBA the permitting authority <br /> for adult zoning. There was discussion of localities for adult entertainment, <br /> Mr. Regan moved to adjourn.
