MASHPEE BOARD OF APPEALS <br /> Minutes <br /> Wednesday, March 11, 1998 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, March 11, 1998 at 7:30 <br /> P.M. at the Mashpee Town Hall. Board members present were: Edward M, Govoni, <br /> Chairman; James E. Regan III, Vice-Chairman; Cheryl A. Hawver, Clerk and Associate <br /> Members Michael A. Makunas, Robert G. Nelson, Richard T, Guerrera and James M. <br /> Dorgan. Building Inspector William F. Hauck was in attendance. <br /> hlaftee Ind stria]Park Trust Paul n m erTrustee- The application requests a <br /> Special Permit under Sections 174-25.B.6, 174-25,D.5 and 174-25,H.6 for a 250 foot <br /> high self-supporting telecommunications transmission tower and a 40 foot by 50 foot <br /> equipment building on property located in an I-1 zoning district at 154 Industrial Drive <br /> (Map 88, Block 31)Mashpee, MA. (Owner of record: Mashpee Industrial Park Trust, <br /> Paul DeRuyter, TRS.) The application was filed by Sprint Spectrum L.P. and a Request <br /> for Modification to change the applicant to Mashpee Industrial Park Trust,Paul <br /> DeRuyter, Trustee was approved on January 14, 1998. <br /> Members sitting: E. Govoni, C. Hawver, J. Dorgan <br /> Mr. Makunas stepped down for this hearing. Attorney Patrick Butler represented the <br /> applicant and reviewed the conditions for the decision. He requested that the 10-year life <br /> of the permit be extended to 15 years when it could be renewed after a public hearing. <br /> Mr. Govoni asked for a change in Condition#14 to allow town use with earnings <br /> language and Mr. Butler agreed. Mr. Govoni asked that#13 condition be expanded to <br /> include"due to transmissions by this facility". Mr. Regan questioned how changes in <br /> technology would be treated and Mr. Butler said they would be required to seek a <br /> modification of the permit. They added "Mashpee Industrial Park Trust shalt report to the <br /> Board of Appeals any change in technology...." <br /> Ms. Hawver moved to grant the Special Permit. Mr. Dorgan seconded.
