Board of Appeals Minutes -February 25, 1998
2.
MashDee Industrial Park Trust Paul deRu er. Trustee-Requests a special permit under
Sections 174-25B(6),D(5), H(6), to allow for construction of a 250' radio
telecommunications facility and an associated 24'x 48' equipment building. The property
is located in an I-1 zoning district at 154 Industrial Drive (Map 88, Block 31)Mashpee,
Massachusetts, and is shown as Lot 28 on a subdivision plan recorded in Plan Book 411,
Page 73. The original application was filed by Sprint Spectrum and modified on January
14, 1998 to change the applicant to Mashpee Industrial Park Trust.
Members sitting; E. Govoni, C. Hawver, J. Dorgan
Mr. Makunas stepped down from the Board for this hearing. Attorney Patrick Butler
reviewed the previous hearing and said he was providing information requested by the
Board on the wind load and fall zones. He explained that Cape Electronics will be
responsible for maintaining the tower. He submitted a letter from Edmund Kirk, attorney
for abutters, the Crowleys, saying they did not object. He reviewed the design of the
tower and wind and ice impacts. He said it would stand 180 miles per hour of wind and
can be designed to have a membrane weakness to break within a specific area.
Mr. Govoni said he wanted the Mashpee Industrial Park Trust to be responsible for
everything on the tower. He reviewed a list of conditions including RFR monitoring and
wanted to know number of facilities, maintenance plans, abandonment provisions and
modifications to the permit. Mr. Butler asked for a vote and then time to review the
conditions and asked if the applicant could have extensions of the present permit after a
certain time rather than apply for a new ,Special Permit. Mr. Govoni stated he would
prefer to take it under advisement and allow time to review all conditions. He said the
Board was concerned with safety and interference and would like these issues addressed.
He also stated that a landscape bond should be posted for the building.
Mr. Govoni moved to take the Petition under advisement. Ms. Hawver seconded. All
agreed. Mr. Hauck questioned height of fence and Mr. Butler said it was 6 feet with
barbed wire at top. Mr. Hauck said this should secure the bottom of the tower.
Cram L nch-Requests a Variance from Section 174-25.1.9 of the Zoning By-laws for
permission to exceed the 70 foot dock length limit to allow a 161 foot dock on property
located in an R-3 zoning district at 70 Popponesset Island Road (Map 106,Block 28)
Mashpee,MA, (Owner of record Albert A. and Lillian Hollander).
is
