Board of Appeals Minutes - January 14, 1998 <br /> 2. <br /> S rin S e trum LT. -Requests a Modification to the Special Permit application SP-97- <br /> 70 to change the applicant from Sprint ,Spectrum L.P. to Mashpee Industrial Parr Trust, <br /> Paul DeRuyter, Trustee and Sprint Spectrum L.P. The application requests a Special <br /> Permit under Sections 174-25.B.6, 174-25,D.5 and 174-25.H.6 for a 250 foot high self- <br /> supporting telecommunications transmission tower and a 40 foot by 50 foot equipment <br /> building on property located in an 1-1 zoning district at 154 Industrial Drive(Map 88, <br /> Block 31)Mashpee, MA. (Owner of record: Mashpee Industrial Park Trust, Paul <br /> DeRuyter, TRS.) The public hearing on this Special Permit was continued from <br /> November 12, 1997 to January 14, 1998, <br /> Mr. Makunas stepped down from the Board for this hearing, <br /> Members sitting: E. Govoni, C. Hawver, J. Dorgan <br /> Attorney Pat Butler informed the Board that he would like to change the Modification to <br /> have Mr, DeRuyter as the sole applicant and eliminate Sprint in the application. He <br /> wanted the owner of record to be the applicant and that Sprint would be a tenant on the <br /> tower. He said the tower would be used for a number of tenants, <br /> Mr. Govoni moved to grant the Modification of the Special Permit to change the applicant <br /> to Paul DeRuyter, TRS, Ms. Hawver seconded. All agreed <br /> Attorney Butler discussed the use of the lot for a self-sustaining tower and equipment <br /> building. 92.3% of the lot will be put in a conservation agreement for open space which is <br /> why it was chosen for the tower. He reviewed a map of suitable locations for towers <br /> which was prepared by the Cape Cod Commission. He said it was appropriate by FAA <br /> standards for the location of multiple uses and presented a sketch of possible tenants. He <br /> discussed lighting and said there would be maximum lighting at the top and reduced <br /> lighting at the bottom. <br /> Ms. Hawver asked how the tower would be handled if the technology became obsolete <br /> and was abandoned- Mr. Butler said the permit can be conditioned for on-going <br /> maintenance and operation of this facility as proposed and if there were any changes the <br /> Board would require a Modification to the Special Permit. He expects that utilization will <br /> be increasing rather than decreasing. <br /> David Maxson, a consultant on radio communications from Broadcast Signal Lab, said <br /> there should be no interference with radio signals in the area. Mr. Govoni asked who <br /> would guarantee that there be no interference and Mr. Butler responded that this could be <br /> a condition of the Permit. Mr. Dorgan questioned why this type of tower was chosen and <br /> Mr. Butler said the design of this tower was chosen to fit the lot. Mr. Govoni asked if the <br /> antennas would work on the present tower and Paul Foley said that tower was for home <br /> TV and did not have room for the cellular use. <br />
