Board of Appeals Minutes -January 14, 1998 <br /> 3. <br /> Mr. Dorgan questioned how coverage can be expanded with the growth in use and Mr. <br /> Maxson said additional facilities can be added without the same height requirement but <br /> need to be above treetops. Mr. Butler said town use of the tower would be donated, <br /> Gay Wells, Cape Cod Commission, questioned location of tenants on the tower at 20 feet <br /> on center, Mr. Maxson said it is standard to use a 10 foot figure between apertures. <br /> John Bologna, structural engineer, reviewed the structural integrity of the structure, He <br /> said Mass, Codes regulate construction based on wind and ice projections. Mr. Govoni <br /> asked about design of tower to have it implode so that it could not fall on a building, Mr. <br /> Butler said it was a building on the adjoining lot which would be in a fall zone. Mr, <br /> Bologna said a weak link could be included to force it to collapse in one direction. <br /> George Toomey, a direct abutter, said the tower was too close to his building, Mr, <br /> Bologna stated it was about 200 feet, Mr. Butler suggested that a condition of the permit <br /> require engineering and documentation to be presented to Building Inspector with specific <br /> data to mare sure that the fall zone was within the location of the property and would not <br /> exceed the distance to the adjacent building. Mr. Dorgan suggested that the permit define <br /> the fall zone and that no buildings be constructed in the fall zone, Mr. Bologna said the <br /> would provide engineers plans defining fall zone and not intrude on other properties and a <br /> summary of the wind design criteria under the code, <br /> Mr, Govoni said someone has to be responsible for interference with so many tenants and <br /> potential sites on the map were selected by the planning department and not <br /> that tower should be collapsible. Gay Wells of the Cape Cod Commission said that the Commission. She suggested the permit include provisions for dismantling, removal and the Cape Cod <br /> restoration of the site if the tower became obsolete and that a bond could be posted to <br /> guarantee performance. Bill Hauck said the Design Review suggested the entrance to the <br /> lot be located at a more level area <br /> Mr. Govoni moved to continue to February 25. Ms, Hawver seconded. All agreed, <br /> Paul 3, Martick- requests a Variance from Section 174-32 of the Zoning Bylaws to <br /> allow the construction of a single family dwelling on an unpaved road on property located <br /> in an R-3 zoning district at 49 Amy Brown Road (Map 109, Block 2)Mashpee, MA. <br /> Members sitting; E, Govoni, J. Dorgan, M. Makunas <br /> Mr. Govoni said that the Planning Department has released the covenant on the lots at the <br /> end of the road and that the Planning Board engineer had approved it. Mr. Govoni moved <br /> to grant the Variance. Mr. Makunas seconded, All agreed. <br />
