Board of Appeals Minutes - January 14, 1998 <br /> 6. <br /> Technical Review Board requested that the driveway be moved and Mr. Makunas stated <br /> that they have no authority. Mr. Dorgan said they should wait for the Town's traffic <br /> study. <br /> Mr. Govoni said the Board wants suggestions on location of driveway. Mr. Dorgan <br /> wanted more information on the handling of the gray water in the building and does the <br /> grease get pulled out of the system. Mr, Reynolds said the system treats the water and <br /> removes grease and oil. <br /> Mr. Mills presented a right of way sketch showing distance from rotary. He questioned if <br /> issue of 6001 from the rotary could be resolved. Mr. Kevin Kirrane, attorney for an <br /> abutter, said the Board should take a literal interpretation of the minimum separation of <br /> 200' from adjoining driveway. He said that no one has stated that the proposed driveway <br /> is at the maximum feasible separation and he believes they need a variance, Mr. Makunas <br /> suggested the driveway be moved to the east. <br /> Mr. Dorgan moved to invoke Chapter 593 and continue hearing. Mr. Govoni seconded, <br /> All agreed. <br /> Ste hen C. K os TRS. -Requests a Special Permit under Sections 174-25,E.1 and 174- <br /> 25.H6 of the Zoning By-laws for permission to operate a grocery/convenience store <br /> (Chaudhry's Market)in a portion of a building permitted for a donut and pastry shop <br /> (Honeydew Donuts) on property located in a C-2 zoning district at 44 Falmouth Road <br /> (Map 55, Block 18)Mashpee, MA, <br /> Members sitting: E. Govoni, C. Hawver, M. Makunas <br /> Mr. Govoni said that the applicant had met with Design Review and posted a bond. Mr. <br /> Govoni moved to grant the Special Permit with the condition that the landscaping conform <br /> to the original landscape plan as modified by the Design Review Committee on <br /> 14, 1998, Ms. Hawver seconded. All agreed, January <br /> Dunkin' Donuts -Attorney Kevin Kirrane presented the Board with a check for $6,450 <br /> for the traffic consultant and requested that the hearing be closed. <br /> Members sitting: E, GOvOni, M. Makunas Members present: C. Hawver, R. Guerrera <br /> Mr. Makunas moved to take the Petition under advisement and accept the funds for the <br /> consultant. Mr. Govoni seconded. All agreed. The Board reviewed the calendar and <br /> determined that the deadline for final filing of the decision is April 14, 1998. <br /> Minutes -Ms. Hawver moved to accept Minutes of November 12 and December 10 <br /> 1997, Mr, Makunas seconded.
