TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, June 26, 1996 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, June 26, I996 at 7:30 <br /> P.M. at the Carol H. Jacobson Senior Center, 500 Great Neck Road North, Mashpee, <br /> MA. Board members present and acting throughout were Edward M. Govoni, Chairman- <br /> James E. Regan III, Clerk and Associate Member Robert G. Nelson, Associate Member <br /> Cheryl A. Hawver was absent. Building Inspector William F. Hauck was present. <br /> Richard M. and Estelle G. Cushner-Request a Special Permit under Section 174-2519 of <br /> the Zoning By-laws for the replacement of a seasonal dock with a permanent dock on <br /> property located in an R-3 zoning district at 22 Samoset Road (Map 125, Block 65) <br /> Mashpee, MA. <br /> Members sitting: E. Govoni, J, Regan, R. Nelson <br /> Engineer Jeff Johnson represented the applicant and informed the Board that the Cushners <br /> had received a Special Permit from the Board of Appeals but the other regulatory <br /> permitting took more than two years and the original permit has expired. Mr. Hauck said <br /> they did not require a Variance since the original dock was built before 1983. Mr. Govoni <br /> stated that the harbormaster, shellfish constable and Conservation Commission have <br /> approved the dock. <br /> Mr, Nelson moved to grant the Special Permit for the new pier with the findings that the <br /> proposed dock will be accessory to an existing dwelling and will not interfere with free <br /> passage of travel by water or land or cause or contribute to the degradation of the marine <br /> environment. Mr. Govoni seconded and stated that the dock will be 132' to mean high <br /> water and the length is not greater than the length of a previous dock built before 1983. <br /> All agreed. <br /> Joseph Daniele et al - has filed an Appeal of the Building Inspector's decision regarding a <br /> dispute over the layout of Child's Road and property of Thomas F. and Bonnie A, Smith <br /> at 226 Monomoscoy Road (Map 114, Block 47)Mashpee, MA, The applicants claim that <br /> the Smith property encroaches on the layout of Child's Road and seek zoning enforcement <br /> action. <br /> Members present: E. Govoni, J. Regan, R. Nelson <br /> Mr. Daniele informed the Board that his attorney was delayed and asked that the hearing <br /> be moved to later in the evening. All agreed. <br />
