Board of Appeals Minutes - October 22, 1997 2 <br /> Robert McNutt, an abutter, stated that when he sold the property to Mr. Kyros he was <br /> assured that he would not nun any business competitive to his. Mr. Kirrane said that <br /> competition between business would benefit the public. <br /> Mr. Govoni moved to take the Petition under advisement. Ms, Hawver seconded. All <br /> agreed. <br /> Francis 3. and Lori S. Labrec ue-Requests a Variance from Sections 174-28 and 174-31 <br /> of the Zoning By-laws to allow a 9.2 foot sideyard setback and an 11.3 foot frontyard <br /> setback on property located in an R-3 zoning district at 8 Capstan Circle (Map 111, Block <br /> 99) Mashpee, MA. <br /> Francis I and Lori S Labrecque-Request a Special Permit under Section 174-17 of the <br /> Zoning By-laws for permission to expand a pre-existing non-conforming dwelling with an <br /> 18 foot by 24 foot addition to replace an existing 8 foot by 12 foot shed on property <br /> located in an R-3 zoning district at 8 Capstan Circle (Map 111, Block 99)Mashpee, MA. <br /> Members sitting: E, Govoni, I Regan, C. Hawver <br /> Architect Tony Ferragamo represented the applicant and presented plans for the expansion <br /> of a single family home. He explained that the site is located entirely in the Fema Flood <br /> Zone and was in the R-75 zoning district and not the New Seabury Special Permit area. <br /> He stated that Conservation has approved the plans. He explained that an existing storage <br /> shed will be removed and replaced with a 18' x 24' garage with a family room on the <br /> second flood. He noted that the house is built on a crawl space because of the flood zone <br /> and the owners need additional storage area. The lot coverage will be 19.5%. He <br /> explained that a hardship exists in use of the triangular lot in a flood zone with the <br /> environmental restrictions. <br /> Ms. Hawver moved to grant a Variance of.8 feet to allow one side yard setback of 9.2 <br /> feet and a Variance of 8.7 feet to allow a front setback of 11.3 feet Bill Hauck confirmed <br /> that the R-75 zoning applicable required a 20 foot front setback and 10 foot side setback. <br /> Mr. Govoni seconded. All agreed. Ms. Hawver said the proposal would be less <br /> detrimental since they would be removing a non-conforming shed. <br /> Ms. Hawver moved to grant the Special Permit to expand the non-conforming structure, <br /> Mr. Govoni seconded and stated that the addition would not be closer to the wetlands and <br /> will not increase lot coverage. Mr. Regan seconded. All agreed. <br /> r <br /> Gerald V. and Dorothy R.
