TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> Minutes <br /> Wednesday, September 24, 1997 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, September 24, 1997 at <br /> 7:30 P.M. at the Mashpee Town Hall, Board members present were Edward M. Govoni, <br /> Chairman; James E. Regan III, Vice-Chairman; Cheryl A. Hawver, Clerk and Associate <br /> Members Robert G. Nelson, Richard T. Guerrera, James M. Dorgan and Michael A. <br /> Makunas, Building Inspector William F. Hauck was also present, <br /> Frederic W. Bl he - Requests a Special Permit under Section 174-25.I.9 of the Zoning <br /> By-laws for permission to construct a pier, ramp and float on Popponesset Creek in an R- <br /> 3 zoning district on property located at 228 Wading Place Road (Map 112, Block 59) <br /> Mashpee, MA, Special Permit 92-46 was granted by the Board of Appeals for this use <br /> and fled with the Town Clerk on September 24, 1992 and has expired. <br /> Members sitting: E. Govoni, C. Hawver, M. Makunas <br /> Mr. Govoni explained that a Special Permit had been issued in 1992 and was appealed and <br /> remanded back to the Board and then dismissed by the Court. He said this was a <br /> rehearing of the same application. Comments were received from Attorney Francis <br /> Collins representing a direct abutter Mr. Siegfried. He said they were concerned that the <br /> conditions had changed at the site and that the Siegfried's wish to apply for a dock on <br /> their land. He asked for a delay in the decision until an Army Corps of Engineer permit <br /> was obtained. Mr. Govoni read a Decision from Judge John M. Xifaras confirming the <br /> boundaries of the Blythe land. He noted that the Conservation Commission and <br /> Harbormaster had approved the plans. <br /> Norman Hayes, a scientist with the BSC Group, presented a sketch of the site to review <br /> changes in the area. He asked if there was a change in the Board's determination of length <br /> and Mr. Govoni said the Board follows Conservation guidelines, Mr. Govoni said this <br /> application has been to court and remanded and dismissed. Mr. Makunas said if Mr. <br /> Hayes was to make a presentation he did not understand why he did not provide copies to <br /> the Board for the public record. <br /> I, <br /> Mr. Makunas moved to grant the Special Permit Ms, Hawver seconded.
