Board of Appeals Minutes - September 24, 1997 <br /> 2, <br /> Mr. Mohns informed the Board that he had converted a two-car garage into an apartment <br /> in 1988 for use in the winter since it is independently heated from the main house. He <br /> stated that the apartment has six exits and does not appear to be a two-family house. He <br /> said there is no intention to use the property as a two-family house but he had concerns on <br /> insurance coverage on the second kitchen. Mr, Hauck explained that a prospective buyer <br /> wants to continue the use of the property in the same way. <br /> Ms. Hawver moved to grant a Special Permit for an existing in-law apartment with the <br /> condition that the apartment will not be rented but will be used by the owner for family <br /> use. She found that the addition met the setback requirements. Mr. Dorgan seconded. <br /> All agreed. <br /> FireChief Geor a Baker -Requested time to make comments concerning the Lipnosky <br /> hearing since he had to attend another meeting. The Board agreed. <br /> Chief Baker said he would like to comment generally on 174-32 of the By-laws since the <br /> Board has many requests to vary this. He said that fire department vehicles have changed <br /> so the department no longer uses brush breakers with four-wheel drive which were used <br /> on dirt roads. He explained the the new vehicles have trouble with turns and cannot <br /> handle pot holes and can make the best response to a fire on hard surfaced all-weather <br /> roadways. He asked the Board to consider this when a Variance request is made. <br /> Louis and Roberta A, Bevilac ua - Requests a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the 15 foot side setback requirement to allow for <br /> the addition of a closet on the north side of the house which will result in a side setback of <br /> 13 feet. The property is located in an R-3 zoning district at 27 Keel Way(Map 120 Block <br /> 135)Mashpee, MA. <br /> Members sitting: E. Govoni, I Regan, C. Hawver <br /> Architect Fred Giampetro represented the applicant and presented pians for an expansion <br /> of the closet in the master bedroom. He explained that the house was in a flood plain and <br /> could not have basement storage and would result in a 13 foot side line setback. Mr. <br /> Nelson questioned the location of the swimming pool and if it met the setback <br /> requirements. Mr. Hauck explained that the pool had been built in 1988with a building <br /> permit and that the statute of limitations had expired so that a variance for the swimming <br /> ;I <br /> pool was not required. <br /> Mr. Regan moved to grant the Variance, Ms. Hawver seconded and all agreed. <br /> Ie <br /> is <br /> i <br /> l <br /> i' <br /> i <br />
