MASHPEE BOARD OF APPEALS-MAY 14, 1997-PAGE 2 <br /> Walter and Joan Francis- Request a Variance from Section 174-31 of the Zoning By-laws for <br /> permission to vary the setback requirements of property located in an R-3 zoning district at 24 <br /> Riverside Road (Map 119, Block 1 I8)Mashpee, MA (Owner of record: Lyle W. Bovee). <br /> Members sitting: R. Nelson, J. Dorgan, J. Regan <br /> E. Govoni stepped down for this hearing. Cape & Islands Engineering represented Walter and <br /> Joan Francis. After presenting plans detailing the reasons for requesting said variance and after <br /> comment from abutters, Mr. Nelson moved to grant the motion quoting findings as follows: that <br /> a literal enforcement of the by-laws would involve hardship to the petitioner; that relief may be <br /> granted without detriment to the public good; the lot has been maintained as a separate buildable <br /> Iot on the Assessor's Records (and is subject to betterments from the water district.). Mr. Dorgan <br /> seconded. All agreed. <br /> Tedi C. Marsh- Requests a Special Permit under Section 174-25.1.9 of the Zoning By-laws for <br /> the construction of a pier, ramp and float on property located in an R-3 zoning district at 77 <br /> Lighthouse Lane (Map 90, Block 50) Mashpee, MA. " <br /> Members sitting: E. Govoni, C. Hawver, and J. Regan. <br /> Tedi C. Marsh was represented by Cape& Islands Engineering. The board was presented with <br /> plans and sketches regarding the proposed pier, ramp and float. J. Regan moved to grant the <br /> Special Permit quoting the following findings: the proposed dock will be accessory to an existing <br /> dwelling and is a permissible use upon the grant of a Special Permit; the proposal has been <br /> reviewed by the Harbormaster and the Shellfish Constable whose responsibilities include safety on <br /> the water and protection of the marine environment; the proposal has been reviewed by the <br /> Conservation Commission to address the impacts on the coastal environment; and the use is in <br /> harmony with the general purpose and intent of the By-laws. E. Govoni seconded. All agreed. <br /> SandeeD D. and Rachel Alva- Request a Variance from Section 174-25.I.9 of the Zoning By-laws <br /> for permission to exceed the 70' dock length Iimit on property located in an R-3 zoning district at <br /> 190 Daniel's Island Road (Map 100, Block 22) Mashpee, MA. <br /> Members sitting: J. Dorgan, C. Hawver, E. Govoni <br /> J. Regan stepped down for this hearing. Plans were presented by Cape&Islands Engineering. <br /> Comments were made by abutter E. Thomas Jones and a letter from Richard York of the <br />
