Board of Appeals Minutes-March 12, 1997 2
Mr. DeDecko had spoken with Deputy Fire Chief who found no objection to this construction.
Plans were presented.
Ms. Hawver moved to grant the Variance stating the applicants were seeking relief because it was
an unpaved road; the fire department raised no objections where it does have at least 20 feet, and
there is existing development surrounding the proposed site. Mr. Dorgan seconded. All agreed.
Cornish Nominee Trust- Requests a Special Permit under Sections 174-25.F.5 and 174-25.H.6. of
the Zoning By-laws for the retail sale and display of garden sheds and furniture and children's
jungle gyms on property located in a C-I zoning district at 620 Falmouth Road (Map 74, Block 6)
Mashpee, MA.
Members sitting: M. Makunas, C. Hawver, E. Govoni
John Renz represented Cornish Nominee Trust. Brochures were presented to show the type of
products which would be sold at the proposed retail facility. Several issues were raised by the
Board. Among them, Mr. Govoni discussed the current complaints received relative to the flea
market made by Deer Crossing residents, such as excessive litter and traffic, in hopes of avoiding
similar problems. Mr. Dorgan suggested there may be a liability problem with individuals
climbing and/or utilizing the structures after business hours since the facility will be unattended at
night. Because of the issue of the appearance of the site, Mr. Govoni suggested perhaps a
meeting before Design Review may be prudent.
Mr. Govoni moved to continue the hearing. C. Hawver seconded. All agreed.
Minutes- Mr. Govoni moved to accept the Minutes of the February 12 and 26. Mr. Nelson and
Ms. Hawver seconded, respectively. All agreed.
D J.
