TOWN OF MASHPEE <br /> Zoning Board of Appeals <br /> Minutes <br /> Wednesday, April 28, 1999 <br /> The Mashpee Board of Appeals held a meeting on Wednesday,April 28, 1999, at <br /> 7:30 P.M. at the Mashpee Town Hall. Board Members present were Vice Chairman <br /> James E. Regan III, Board Member Robert G.Nelson and Associate Members Richard T. <br /> Guerrera and James M. Dorgan. Building Commissioner William F. Hauck and Local <br /> Inspector Russell W. Wheeler were in attendance. <br /> Bruce H. &„Bernadine M. Urquhart—Request a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the sideline setback requirements to allow for <br /> construction of an attached garage to property located in an R-3 zoning district at 130 <br /> Surf Drive (Map 102 Block 64) Mashpee, MA. <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. Shawn Gilfoy, a builder, represented the applicants who propose to construct an <br /> attached garage to their existing home. He stated that the proposal is for a 17.6 foot <br /> wide x 2” `bot deep garage. Mr. Gilfoy also stated that the font half of the garage is <br /> '' -dway fi-om the lot line, however, the rear setback will be 10 feet away from the <br /> iot line. The applicants are seeking a relief of five feet from the setback requirements on <br /> the back corner of the lot. The applicants have reduced the size of the garage to avoid <br /> constructing within the drainage easement. Mr. Urquhart also attended the meeting. <br /> Mr.Nelson stated that the applicants are meeting the easement line. Mr. Gilfoy <br /> confirmed that the construction will be two inches away from the easement line. Mr. <br /> Nelson questioned the amount of distance fi-om the face of the concrete to the outside of <br /> the shingles or clapboard. Mr. Gilfoy stated that it will be less than two inches. Mr. <br /> Nelson stated that he has no argument with the proposal as long as the construction will <br /> not be in the easement area. Mr. Gilfoy assured the Board that they will stay out of the <br /> easement area. He also stated that the garage is slightly wider to accommodate the side <br /> entry door. <br /> Mr. Nelson informed the other Board members that the subject property and one other are <br /> the only homes in the vicinity without a garage. He stated that the construction of the <br /> garage will benefit the applicants and the other families of Seabrook Village. <br /> No comments were received from abutters. <br /> Mr. Nelson moved to grant the Variance of 4.9 feet from the sideline setbacks on the <br /> easterly sideline of the lot, subject to Criteria: 1(the house is centered on the lot),2,3,4; <br /> Findings: 1. Mr. Guerrera seconded. All agreed. <br />
