Board of Appeals Minutes—April 28, 19 99 2 <br /> Michael J. & Jodi Car entier—Request a Variance from Section 174-31 of the Zoning <br /> By-laws for permission to vary the sideline setback to allow for construction of an <br /> attached garage to property located in an R-5 zoning district at 31 Pierre Vernier Drive <br /> (Map 2 Block 148) Mashpee, MA. <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. and Mrs. Carpentier represented their application. They propose to construct an <br /> addition and an attached two-car garage with a small entryway. They submitted a letter <br /> from an abutter, Julie Shea, who has no objection to the proposal. <br /> Mr. Nelson questioned the sideline setbacks in that area. Mr. Hauck stated that the <br /> sideline setback is 15 feet because it is a cluster subdivision,with 20 foot rear setback <br /> and 30 foot fi•ont setback. <br /> Mr. Regan stated that the proposed construction falls under the allowed 20%. Mr. <br /> Guerxera questioned if the applicants are putting anything in the upper level of the <br /> garage. Mr. and Mrs. Carpentier stated that nothing is proposed for the second floor. <br /> Mr. Guerxera moved to grant the Variance of five feet fiom the sideline setback <br /> requirements on the southerly side of the lot, subject to Criteria: 1,3,4; Findings: 1. Mr. <br /> Nelson seconded. All agreed. <br /> John C. & Sandra S. Hessler—Request a Variance from Section 174-32 of the Zoning <br /> By-laws for permission to construct a new single-family home on an unpaved road on <br /> property located in an R-3 zoning district at 84 Punkhoin Point Road(Map 100 Block 5) <br /> Mashpee, MA. <br /> John C. & Sandra S. Hessler—Request a Special Permit under Section 174-20 of the <br /> Zoning By-laws for permission to demolish an existing non-conforming dwelling and <br /> construct a new dwelling on property located in an R-3 zoning district at 84 Punkhom <br /> Point Road(Map 100 Block 5)Mashpee, MA. <br /> Members sitting: James E. Regan III, Robert G. Nelson and Richard T. Guerrera. <br /> Mr. John Slavinsky of Cape & Islands Engineering represented the applicants who <br /> propose to remove the small cabin on the lot and build a new house. The property is <br /> located at the end of Punkhorn Point Road. The applicants received approval on April 8, <br /> 1999 from the Conservation Commission, subject to BOA approval. Mr. Slavinsky <br /> stated that the proposed building will be 250 feet from a paved road and the property line <br /> is 100 feet from a paved road. <br /> Mr. Slavinsky stated that the applicants propose a combination garage/shed that will <br /> measure 16 feet x 18 feet. Mr.Nelson questioned if there is a roof connecting the <br /> garage/shed to the house. Mr. Slavinsky answered that it will not connect. <br />
