Board of Appeals Minutes—April 28, 1999 5 <br /> Mr. Regan reminded the Board about the letters received at the last hearing on April 14, <br /> 1999 from Little Neck Bay Association and one abutter expressing concern regarding <br /> entrance and egress to and from the subject lot and maintaining natural vegetation <br /> between the lots. Mr. Regan confirmed that those concerns are addressed with the <br /> re-engineering of the structure to meet the front setback requirements. Mr. Slavinsky <br /> also assured the Board that no natural vegetation will be touched between the two lots. <br /> Mr. Regan stated that the applicant has worked hard to keep the neighbors and Little <br /> Neck Bay Association happy with the proposed project. <br /> MI. Slavinsky stated that a denitrification system will be installed. He also stated that the <br /> lot coverage will be 14%. <br /> No other comments were received fiom abutters. <br /> Mr. Nelson moved to grant a Variance, subject to: <br /> • a strip of natural vegetation will remain for a distance of five feet fiom the <br /> southerly property line from Tide Run to the marsh. -- <br /> • criteria: 1,2,3,4. <br /> • findings: 1,2,3,4. <br /> Mr. Guerrera seconded. Schlundt—Request a Special Permit under Section 174-25.1.9. <br /> of the Zoning By-laws for permission to construct a pier, ramp and float on Jehu Pond on <br /> property located in an R-3 zoning district at 27 Wheelhouse Lane (Map 120 Block 166) <br /> and 5 Waterline North Drive (Map 120 Block 171)Mashpee, MA. (Owner of record of 5 <br /> Waterline North Drive: New Seabury Properties L.L.C.) <br /> Members sitting: James E. Regan IR, Robert G.Nelson and Richard T. Guerrera. <br /> Mr. Norman Hayes of the BSC Group represented the applicants and stated that the <br /> Conservation Commission, Harbormaster Perry Ellis and Shellfish Constable Richard <br /> York have all approved the project. Mr. Hayes informed the Board that the proposal is a <br /> Harbormaster Section 10A permitted float. However, when the float with the ramp <br /> becomes attached to the Conservation Commission-approved walkover structure, it <br /> necessitates the request for a Special Permit from the Board of Appeals. Mr. Hayes said <br /> that the applicants are seeking permission to connect the temporary ramp to the walkover <br /> structure. He also said that the applicants have received authorization fiom New Seabury <br /> LLC for the connection of the ramp and walkover structure. Mr. Hayes submitted a letter <br /> from the Little Neck Bay Association expressing approval of the project. He also <br /> submitted letters from the Architectural Review Committee stating that they will support <br /> the Little Neck Bay Association's approval. There is no need for Army Corps of <br /> Engineers approval as this project is strictly a Harbormaster Section l0A temporary, <br /> seasonal ramp and float. Mr. Hayes said that the entire structure will not exceed 70 feet. <br /> He stated that the structure will remain in the water from May until it is removed in <br /> October to be stored at Little River Boatyard.
