Board of Appeals Minutes—April 28, 1999 4 <br /> Members sitting: James E. Regan III,Robert G.Nelson and Richard T. Guerrera. <br /> Mr. John Slavinsky represented the applicant, Mr. and Mrs. Quigley who also attended <br /> the meeting, and stated that the Conservation Commission has approved the project, <br /> pending BOA approval. The applicants propose to convert the existing house on the <br /> property into a garage. Parts of it, such as the porch and utility room, will be removed. <br /> Mr. Slavinsky stated that Board of Health was guaranteed that the applicant is not <br /> creating an apartment in the garage. There will be no septic, heat or water service to the <br /> structure. There is a sworn affidavit to that effect by the applicants. <br /> The existing cesspool will be replaced with a denitrification system. <br /> Mr. Slavinsky stated that the applicants propose to build a three-bedroom home. Lot <br /> coverage will be 7.2%. No variance relief is sought. Mr. Slavinsky stated that the new <br /> garage will be built on a slab. <br /> No comments were received fiom abutters. <br /> Mr.Nelson moved to grant the Special Permit, subject to: <br /> • Criteria/findings: 1,2,3,4,6 <br /> • the proposed building conforms to the setback requirements. <br /> the proposed renovation of the house will be farther from the wetlands <br /> than the existing structure. <br /> • the lot coverage is 7.2%. <br /> • the proposal is an improvement. <br /> • confirmation from the Conservation Commission indicating approval of the <br /> project. <br /> CONTINED HEARINGS <br /> Fred Glass—Requests a Variance from Sections 174-31, 174-85 and 174-86.F. of the <br /> Zoning By-laws for permission to construct a new dwelling within the ACEC and to vary <br /> the front yard setback requirements on property located in an R-3 zoning district at 133 <br /> Tide Run(Map 1.20 Block 180)Mashpee,MA. The dwelling will be set back 30 feet fiom the street. The property is <br /> located within the ACEC. The Board received a letter fiom the Conservation <br /> Commission stating that they have approved the project, subject to BOA approval, to <br /> build within the ACEC. <br />
