Board of Appeals Minutes - August 28, 1996 2. <br /> and will use town water. The light poles will be 5' shorter than those on the adjacent 99 <br /> site and will use 10% less lumens in power and will shine down and not off of the lot. A <br /> fence is proposed for the rear of the lot and extensive landscaping and screening of the <br /> dumpster. <br /> Mr. Govoni asked for the measurements on the Variance and Mr. Singer replied <br /> that the distance from Great Neck Road North to the restaurant entrance will be 150 feet <br /> instead of 200 feet and the distance from the driveway to the condominiums is 80 feet. <br /> Paul Lobel, engineer, reviewed the proposed colors of deep blue, gray and buff. <br /> Mr. Govoni reviewed the correspondence and said that the Town Planner had <br /> suggested a denitrification system and that the October Town meeting will vote on an <br /> article to eliminate the need for the Variance. He suggested a directional sign on the <br /> northern side of the property and additional landscaping. Correspondence was received <br /> ' from the DPW approving the plans and from S. Mitrokostos in favor of the restaurant. <br /> Mr. Regan asked about the outdoor dining and hours of operation and Mr. Singer <br /> said dining would be on the concrete sidewalks and hours of operation would be 11;30 to <br /> 8:30. He said signs will meet the requirements of the By-law and will be determined by <br /> the Design Review Committee and the approval of the Selectmen. <br /> Peter Valle of the Sandpiper Village Association presented a petition from 27 <br /> residents of Sandpiper Village opposed to the restaurant. (Attached). He said that 40% of <br /> the condominium area is undeveloped and questioned the parking setbacks and that <br /> residents were concerned with lighting, noise, traffic and increase in seagull population. <br /> Comments were received from several residents in favor of the application and said <br /> Cooke's would cooperate with the Town and be an asset to the community as well as <br /> offer employment opportunities, Sandpiper Village residents commented on odors, traffic <br /> and noise from the 99 Restaurant. <br /> Edward Baker asked for total number of seats in restaurant and was concerned <br /> about impact on groundwater. He asked if there would be a limit on the nitrate level on <br /> the septic system and stormwater drains. Mr. Govoni said that the Board of Health had <br /> the authority on these issues. <br /> Paul Lobel reviewed the landscape plan and noted that there will be an arborvitae <br /> hedge to screen the parking lot from the dentists office. <br /> Mr. Govoni moved to take the petition under advisement. Mr. Regan seconded. <br /> All agreed. Mr. Singer noted that this site would not be having deliveries at night and that <br /> the restaurant will be applying for a liquor license. <br />
