and twenty-five units to a well site. And we' re talking not
about a zone of contribution. We're talking about the wells here
and the development is here. Uh. . . secondarily to that, Town
Meeting voted not to extend the Special Permit past 1994 . That
went to Town Meeting as well and Town Meeting said "no. " In our
opinion, it should expire in 1994 . And this all happened in 195 .
Uh. . .So, I . . . I don' t think there is a direct correlation between
the ' 71 . . . I think if you look at the two articles, I think you
are going to see a substantial difference. Thank you.
The Chairman recognized Russell Babcock.
Russell Babcock: The conditions which the water District
taxed the Board of Selectmen to put in were the minimum
conditions . They chose to leave out three of them. They dial not
consult with the Water District about it at all . Now, I wrote
those conditions and they were the minimum conditions which the
DEP would have set. I suggest to you that if the four hundred
and twenty-five units and the three hundred and forty thousand
square feet of land are there now we would not have a well site
since the DEP would never have approved it .
And the second point is, which may have nothing to do with
this Board, but it does to us as citizens, if we lose this well
site- -would somebody tell us where we are suppose to go to get
some more water.
The Chairman recognized Deirdre Greelish.
Deirdre Greelish: One other question I think I might have
for you. And that is that uh. . . in all the Special Permits I 've
seen you rule on, uh. . . that become very sophisticated with lots
of conditions- -for example, Willowbend or Southport, that take
tremendous amount of time on your part and become very, very
complex documents trying to allow the development and still
protect the public interest, they'd have to be filed. And in
this case all that ' s recorded for even tax purposes, is a piece
of land called Section 5 that allows twenty-five units to go on
it . That ' s what . . . that ' s what still appears on the books .
Therefore, uh. . . it ' s just a piece of paper right now. I suppose
it ' s a contract that they can show to somebody and say, "See, you
can put twenty— four hundred and twenty-five units here. " But
there' s nothing been recorded and registered that would help a
buyer. There is a. . . there is a condition on this property
because of the well field nearby. So, it ' s a very funny
situation and it hasn' t followed the procedure that would have
been in place had you been uh. . . involved, I believe.
The Chairman recognized Christopher Burden.
Christopher Burden: I 'd just like to make uh. . . a couple of
comments . Chris Burden, with New Seabury Company L. P. Uh. . .back
when this . . .when the Town voted for this transfer, this vote was
-16-
