MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> Kristen E. Ferguson. <br /> 79 Cayuga Avenue (Map 58 Parcel 12) <br /> Mashpee,MA 02649 <br /> V-2016-3 8 <br /> The Board had a discussion with the applicant stating that they require a revised <br /> plan that indicates what the lot coverage will be when adding the proposed 14 foot wide <br /> garage. The new plot plan must also depict the requested existing structures, and proposed <br /> dimensions, with 20% lot coverage. The plan should depict a revision date, with the <br /> amended garage dimensions from 18 ft. to 14 ft. Elevation dimensions should be depicted <br /> on the house plans for the Building Department. <br /> At the Public Hearings dated Wednesday, September 28, 2016, Mr. David Rivera <br /> returned to present his house project. At the last hearing the Board requested he provide a <br /> revised plot plan because it was over the percent lot coverage. The Board also requested <br /> that he provide letters from his neighbors for the record. He provided two plot plans, one <br /> that depicted 16' foot wide garage and a 14' foot wide garage. He would prefer the 16' foot <br /> wide garage. He would consider removing the shed to lower the lot coverage. <br /> The Board discussed the location of the shed, and that they would prefer the shed <br /> be moved 5 feet from all property lines as indicated in the bylaws. They also would prefer <br /> the 14 foot wide garage rather than the 16 foot wide garage.The lot coverage is 17.6%with <br /> the 14 foot wide garage. The applicant said he will remove the shed. <br /> Chairman Furbush read an abutter letter from Lynne Catarius, at 85 Cayuga Ave., <br /> Mashpee, MA. He also read an abutter letter from Mina Greene and Doug Fribush, at 80 <br /> Cayuga Ave., Mashpee, MA. He read the Board of Health comments into the record, and <br /> the DPW comment regarding a curb cut permit. <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a <br /> Variance. Upon motion duly made and seconded at the Public Hearings on Wednesday, <br /> September 28, 2016, the Zoning Board of Appeals voted unanimously to issue a side yard <br /> Variance in the amount of 5.2 feet to allow for a garage and porch, as noted on the plot <br /> plan that depicts a 14 foot wide by 36 foot long garage.
