Impey requesting a Special <br /> Permit under§174-25.1 (9) of the Zoning Bylaws to allow for construction of a dock,pier, <br /> ramp and float extending more than 70 feet of coastal beach, coastal bank, salt marsh or <br /> bordering vegetated wetlands,on property located in an R3 Zoning District,(Map 96 Parcel <br /> 11), Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws <br /> Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee, on May 6, 2016 and May 13, 2016 a copy of <br /> which is attached hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee <br /> Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 25, 2016 at which time the following members of the Board of Appeals <br /> were present; Chairman, Jonathan Furbush, Vice Chairman, William Blaisdell, Board <br /> Members, Ron Bonvie, and Scott Goldstein, and Associate Members, Brad Pittsley and <br /> Norman J. Gould. Also present was Building Commissioner,Michael Mendoza. <br /> Mr. Matt Costa with Cape& Islands Engineering represented the petitioner for the <br /> dock project. He said a special permit from the ZBA and an order of conditions from <br /> Conservation were issued back in January, 2013, but the work was not completed and <br /> therefore expired. He reapplied to Conservation and they issued a new order of conditions <br /> on May 12, 2016. The previously approved plan depicted a 97 foot pier that extended <br /> beyond the mean high water, and requires a special permit because it extends over the <br /> coastal beach area, and is classified as wetlands. <br /> Mr. Bonvie asked if he obtained permission from the Harbormaster and Shell Fish <br /> Warden. <br /> Mr. Costa said; yes, notification to those departments is required. He said that this <br /> application has a Chapter 91 License in place. <br /> 1 <br />
