t' TOWN OF MASHPEE Board of Appeals Minutes Wednesday, December 9 , 1992 The Mashpee Board of Appeals held a meeting on Wednesday, December 9 , 1992 at 7 : 30 P .M. at the Mashpee Town Hall . Board members present and acting throughout were John J. Friel, Michael A. Makunas and Cheryl A. Hawver . Building Inspector William F. Hauck was in attendance. Baybury Villa a Association - Requests a Special Permit under Section 174-25 . 1 . 9 of the Zoning By-laws for permission to construct a stairway, pier, gangway and float in an R-3 zoning district on property located on Godfrey Road (Map 96 , Block 1041 ) Mashpee, MA. Members sitting: J . Friel , M. Makunas, C. Hawver Engineer Douglas Cameron represented the applicant and presented plans for a stairway, pier, gangway and float to be used by many of the residents of Baybury Village . The project is located on the Mashpee River and replaces an old stairway. The Board was informed that association members who want to use the dock can participate in the construction costs . All other waterfront lots already have docks . Mr . Makunas moved to grant the permit. Ms . Hawver seconded. All agreed. Benway Sisters_' _Trust - Requests a Variance from Section 174-25 . I .9 of the Zoning By-laws for permission to vary the dock length of 70 ' in an R-3 zoning district on property located at 12 Popponesset Island Road (Map 105 , Block 266 ) Mashpee, MA. Members sitting: J . Friel, M. Makunas, C . Hawver Engineer Sohn Slavinsky represented the applicant and explained that the applicant had received a Special Permit for a dock but that both Conservation and Shellfish Commissions had suggested length be extended 25 ' beyond zoning. This will result in an additional one foot depth of water . A letter was received from Conservation recommending the 95 ' length. Mr. Makunas moved to grant the Variance allowing a 25 ' extension. Ms . Hawver seconded. All agreed.
