Board of Appeals Minutes - October 14, 1992 2 . <br /> Mr . Makunas asked why the applicant had not gone to Design <br /> Review and Mr . Kirrane explained that they needed a <br /> determination on the lot use before working on the other issues . <br /> Mr. Hauck explained that there were commercial lots and an <br /> undeveloped road at the rear. Spiro Mitrokostas, the principal <br /> abutter, had no objection and only was intrested that the <br /> drainage be handled on site. Mr. Hauck said he had no <br /> objections but wanted the Board to be aware of his issues . Mr . <br /> Govoni moved to a grant a 15' Variance for the parking area to <br /> the layout of 151 , a 25 ' Variance on the setback of the building <br /> from Algonquin Ave . and a lot size Variance allowing for a lot <br /> size of 34, 545 sf . Mr. Makunas suggested it be one Variance <br /> with the three adjustments. Mr. Makunas seconded. All agreed. <br /> Mr. Makunas suggested the hearing on the Special Permit be <br /> continued to November 18 , 1992 until other issues were resolved. <br /> Mr . Friel seconded. All agreed. <br /> Daniel J . Hourihan - Daniel J. Hourihan requests a Special <br /> Permit under Section 174-25. 1 . 9 of the Zoning By-laws for an <br /> existing pier, ramp and float in an 9-3 zoning district on <br /> property located at 32 Little Neck Lane (Map 105, Block 10 ) <br /> Mashpee, MA. ( Owner of record: Elizabeth A. Hourihan) . <br /> Members sitting : J. Friel , M. Makunas, E. Govoni <br /> Engineer Michael Borselli represented the applicant and informed <br /> the Board that they are applying for an amnesty license for a <br /> pier built approximately 1983. He said no work was <br /> Conservation had approved it subject to a special permltaseMrand <br /> Friel asked if he was aware of the Shellfish Constable s <br /> comments and read them. Mr. Borselli said Conservation did not <br /> agree with them since they felt there would be more damage to <br /> the environment if dock was altered. <br /> Mr . Makunas moved to grant the Special Permit. Mr . Govoni <br /> seconded. All agreed. <br /> Karen Jalkut - Requests a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the set-back requirements <br /> in an R-3 zoning district on property located at 75 Nick Trail, <br /> (Map 117, Block 100 ) Mashpee, MA. <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Karen Jalkut informed the Board that she had placed a shed on <br /> her property within the setback requirements. She explained <br /> that they were installing a new septic system and the shed would <br /> have to be placed on top of this to meet the requirements. She <br /> said she had contacted all of her direct abutters on the <br /> placement of the shed and no one objected. She presented letters <br /> from abutters in favor. <br />
