TOWN OF MASHPEE Board of Appeals Minutes Wednesday, September 23, 1992 The Mashpee Board of Appeals held a meeting on Wednesday, September 23, 1992 at 7:30 P.M. at the Mashpee Town Hall. Board members present and acting throughout were John J. Friel, Michael A. Makunas, Edward M. Govoni and Jamie Regan. Acting Town Counsel Leslie Morse and Zoning Enforcement Officer William Hauck were in attendance. Deer Crossin2 Associates - Request. a Special Permit under Sections 174-25.D.2, 174-25.D.4 and 174-25 .H.6 for permission to expand Building C at Deer Crossing with an addition for a fitness center in a C-1 zoning district on property located at 681 Falmouth Road (Map 81 , Block 32, Lot 21C) Mashpee, MA. (Owner of record: Shore Crossing Ltd. Partnership) . Members sitting: J. Friel, M. Makunas, E. Govoni Ron Cappozolli represented the applicant and presented plans for an addition to Building C for a fitness center. No comments were received from abutters. Mr. Makunas moved to grant the Special Permit. Mr. Govoni seconded. All agreed. Cape Cod Restaurants - Advisement from September 9, 1992. Members sitting: J. Friel, M. Makunas, E. Govoni Mr. Makunas moved to rescind the Modification to the Special Permit. He stated that the applicant has not complied with any of the four conditions. The applicant was to have supplied a complete engineer's plan, was to have appeared for approval of the plan, was to review curb cuts with D.P.W. and was to report back to the Board within 30 days. There was discussion on rescinding the restaurant permit but Attorney Morse explained that the legal advertising had only included the Modification and this was all that could be rescinded. Mr. Govoni seconded. All agreed. Charles Talanian Trs. - Notice is hereby given that the Board of Appeals will hold a Public Hearing for the purpose of accepting new testimony on the application of Charles M. Talanian TR, for a Modification of the terms of Special Permit 84-03- 01 extended most recently by Special Permit 92-9. Said application was previously heard on July 29, 1992 . Members sitting: J.
