TOWN OF MASHPEE <br /> Board of Appeals <br /> Minutes <br /> Wednesday, September 9, 1992 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, <br /> September 9, 1992 at 7 : 30 F.M. at the Mashpee Town Hall . Board <br /> members present and acting throughout were John J . Friel , Michael <br /> A. Makunas, Edward M. Govoni and Jamie Regan. Zoning Enforcement <br /> Officer William F. Hauck was in attendance . Mr. Friel called the <br /> meeting to order at 7 : 35 P .M. <br /> Elizabeth A. Connolly - Requests a Variance from Section 174-31 of <br /> the Zoning By-laws for permission to vary the setback requirments <br /> in an R-3 zoning district on property located at 39 Kim Path ( Map <br /> 117, Block 91 ) Mashpee, MA. ( Owner of record : Louis McMenamy et <br /> al TR. ) <br /> Elizabeth A. Connolly - Requests a Special Permit under Section <br /> 174-17 of the Zoning By--laws for permission to expand a <br /> non-conforming structure with the replacement of a seasonal <br /> cottage with a year-round home in an R-3 zoning district on <br /> property located at 39 Kim Path (Map 117, Block 91 ) Mashpee, MA. <br /> (Owner of record : Louis McMenamy TRS. ) . Advisement from meeting <br /> of August 12, 1992 . <br /> Members sitting : J . Friel, M. Makunas, E. Govoni <br /> Edward Connolly Jr. represented the applicant . Mr. Friel said the <br /> applications would be combined . Mr. Connolly said that the <br /> Variance was required to accomodate the requirements of the Board <br /> of Health for the new septic system . Mr. Makunas explained that in <br /> hearing the Special Permit the Board discovered a zoning <br /> violation which required a Variance . <br /> Mr. Makunas moved to grant the Special Permit and Variance as <br /> requested . Mr. Govoni seconded . All agreed . <br /> Edward E. Jones - Requests a Special Permit under Section <br /> 174-25 . 1 . 9 of the Zoning By-laws for permission to construct a <br /> pier, ramp and float in an R-3 zoning district on property located <br /> at 202 Daniel ' s Island Road ( Map 100, Block 23 ) Mashpee, MA. <br /> Members sitting : J . Friel, M. Makunas, E. Govoni <br /> Engineer David Sanicki represented the applicant and presented <br /> plans for a low pier made of fiberglass grating which would be <br /> used for planking . Conservation has approved the dock . The <br /> fiberglass grating allows more light penetration to the shellfish <br /> beds . <br />
