Board of Appeals Minutes - September 9, 1992 2. <br /> Rick York, temporary Shellfish Constable, stated that he had not <br /> been able to review the dock applications except for location in <br /> resource areas . He said the Jones pier was in a resource area for <br /> 5 quohogs and clams . Mr. Friel explained that the procedure was to <br /> present comments for the meetings . Mr. Makunas suggested Mr. York <br /> review the plan during the meeting and said he did not feel that <br /> applications should be held up since all plans had been sent to <br /> the Shellfish. Dept . in advance . Mr. York said he had a problem <br /> with prop dredging in the shallow depths . <br /> Mr. Sanicki responded that the applicant is in violation of the <br /> Conservation Commission for old docks and is now pulling boats <br /> ashore causing more damage to the shoreline . He explained that <br /> the 70 ' dock limit in the by-law prevented them from reaching a <br /> depth for larger boats . The current boat is an inflatable boat <br /> requiring only l ' depth. Mr. Sanicki said Conservation had <br /> approved the 5 ' x 20 ' size. <br /> Mr. York said the shallow depth was harmful to shellfish and asked <br /> if there could be restrictions on use of docks and said people <br /> would not be able to get under the float . <br /> Mr. Sanicki said this was a seasonal float and shellfish would be <br /> available off season and explained that it was a similar structure <br /> to two adjacent floats . <br /> Mr.York said he would prefer to see multiple use of existing <br /> structures . Mr. Friel asked if he had inspected this structure and <br /> he replied that he had not. <br /> Mr. Makunas moved to take the application under advisement . Mr. <br /> Govoni seconded . Friel, M. Makunas, E. Govoni <br /> Engineer David Sanicki represented the applicants and presented <br /> plans for an elevated dock 70 ' from the high water mark and <br /> included plans for a stairway for protection of the bank and a <br /> delineation of shellfish beds . He explained that this dock has a <br /> 5 ' elevation for access to shellfish and Conservation has approved <br /> it . <br /> Mr. York said this was also a good shellfish area and very <br /> shallow. He considered float too low. <br />
