Board of Appeals Minutes - September 9, 1992 2. Rick York, temporary Shellfish Constable, stated that he had not been able to review the dock applications except for location in resource areas . He said the Jones pier was in a resource area for 5 quohogs and clams . Mr. Friel explained that the procedure was to present comments for the meetings . Mr. Makunas suggested Mr. York review the plan during the meeting and said he did not feel that applications should be held up since all plans had been sent to the Shellfish. Dept . in advance . Mr. York said he had a problem with prop dredging in the shallow depths . Mr. Sanicki responded that the applicant is in violation of the Conservation Commission for old docks and is now pulling boats ashore causing more damage to the shoreline . He explained that the 70 ' dock limit in the by-law prevented them from reaching a depth for larger boats . The current boat is an inflatable boat requiring only l ' depth. Mr. Sanicki said Conservation had approved the 5 ' x 20 ' size. Mr. York said the shallow depth was harmful to shellfish and asked if there could be restrictions on use of docks and said people would not be able to get under the float . Mr. Sanicki said this was a seasonal float and shellfish would be available off season and explained that it was a similar structure to two adjacent floats . Mr.York said he would prefer to see multiple use of existing structures . Mr. Friel asked if he had inspected this structure and he replied that he had not. Mr. Makunas moved to take the application under advisement . Mr. Govoni seconded . All agreed . Patricia M. and Mary Alice Benway TRS . - Request a Special Permit under Section 174-25 . 1 . 9 of the Zoning By-laws for permission to construct a pier, ramp and float in an R-3 zoning district on property located at 12 Popponesset Island Road (Map 105, Block 266 ) Mashpee, MA. Members sitting : J . Friel, M. Makunas, E. Govoni Engineer David Sanicki represented the applicants and presented plans for an elevated dock 70 ' from the high water mark and included plans for a stairway for protection of the bank and a delineation of shellfish beds . He explained that this dock has a 5 ' elevation for access to shellfish and Conservation has approved it . Mr. York said this was also a good shellfish area and very shallow. He considered float too low.
