Board of Appeals Minutes - June 24, 1992 2. <br /> be installed since the curve in Route 130 was dangerous. Mr. Friel said <br /> Mr. Taylor would try to improve traffic. Spencer Paean, a member of the <br /> audience, asked why they were working on the building without the permit. <br /> Mr. Makunas said they were doing this at their own risk and Mr. Friel <br /> explained that the building was zoned for this use and his only concern <br /> was the completion of the parking area and improvement of the entrance. <br /> Mr. Boyd asked that occupancy. be delayed until appropriate arrangements <br /> were made on the parking and the entrance and exit. <br /> Mr. Govini moved to grant the Special. Permit with the condition that the <br /> applicant meet with Greg Taylor and resolve the problem of the egress to <br /> the property. Mr. Makunas seconded. All agreed. <br /> Erwin and Barbara Brilliant - Request a Special Permit under Section <br /> 174-25.1.9 of the Zoning By-laws for the licensing of an existing dock, ramp <br /> and float in Ockway Bay in an R-3 zoning district on property located at <br /> 43 Little Neck Lane (Map 105, Block 15A) Mashpee, MA. <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Engineer Steven Wilson represented the applicant and presented plans for <br /> an existing dock which the owner considered was built in the 1970's. The <br /> Board discussed the issue of the setbacks from the lot line. Mr. Mindick <br /> confirmed that the structure has been in existence for more than 10 years. <br /> Mr. Makunas moved to make the determination that the structure is an illegal <br /> non-conforming structure and that a variance will, not be required. Mr. Govoni <br /> seconded. All agreed. <br /> Mr. Makunas moved to grant the Special Permit with the condition that <br /> Conservation Commission approval and other permits are obtained. Mr. Govoni <br /> seconded. All agreed. <br /> Norman and Dianne J. Belliveau - Request a Variance from Section 174 -31 of <br /> the Zoning By-laws for permission to vary the setback requirements in an <br /> R-5 zoning district on property located at 41 Lakeview Drive (Map 40, Block <br /> 51 ) Mashpee, MA. <br /> Members sitting: J. Friel, M. Makunas, E. Govoni <br /> Engineer Robert Raymond represented the applicant and explained that the <br /> Board had granted an earlier variance but that the Conservation Commission <br /> now wanted the structure relocated further from the banking. He presented <br /> a letter from the abutter stating no objections. Mr. Friel reviewed the <br /> hardship of the topography. <br /> Mr. Govoni moved to grant the Variance allowing a 12' sideline setback on <br /> the N.E. side and 15' on the front. Mr. Makunas seconded. All agreed.. <br /> Cape Cod Restaurants dba Picnic Box - has Appealed the Decision of the <br /> Building Inspector which cited a violation of the Town's Zoning By-laws with <br /> the sale of produce and flowers without a Special Permit on property located <br /> at 518 Falmouth Road (Map 74, Block 16) Mashpee, MA. (Owner of record: <br /> Fields Point Ltd. Partnership) . <br />
