r <br /> r <br /> TOWN OF MASHPEE <br /> Hoard of Appeals <br /> Minutes <br /> May 13, 1992 <br /> The Mashpee Board of Appeals held a meeting on Wednesday, <br /> May 13, 1992 at 7 : 30 P.M. at the Mashpee Town Hall . Board <br /> Members present and acting throughout were: John J . Friel , <br /> Michael A. Makunas, Cheryl A. Hawver, Edward M. Govoni, Arnold <br /> D. Mindick and Jamie Regan . Building Inspector Douglas S. Boyd <br /> was in attendance. <br /> Mr. Makunas opened the meeting and discussed <br /> reorganization of the Board . He moved to elect John Friel the <br /> Chairman. No . Hawver seconded . All agreed . <br /> Steven R. hall, - Requests a Special Permit under Section <br /> 174-17 of the Zoning By-laws for permission to replace and <br /> relocate a non-conforming structure in an R-3 zoning district <br /> on property located at 55 Amy Brown Road ( Map 109, Block 28 ) <br /> Mashpee, MA. ( Owner of record : John D. Ball ) . <br /> Members sitting : J . Friel , M. Makunas, C. Hawver <br /> Attorney Kevin Kirrane represented the applicant and <br /> presented plans of an existing shed which Mr. Ball wishes to <br /> relocate . The new location will be 4 ' from the property line <br /> rather than the existing 1 . 9 ' . He said Mr. Ball would be <br /> willing to rebuild the original structure if Board prefers this <br /> to a replacement . <br /> Mr. Friel read comments from an abutter in opposition as <br /> well as a comment from the Town Planner questioning the <br /> subdivision. Mr. Friel explained that this was not within the <br /> jurisdiction of the Hoard . Mr. Makunas requested file <br /> information on a previous application. Mr. Mindick questioned <br /> size of proposed structure and was informed it will be 8. 2 x <br /> 12 . 2 . Mr. Makunas reviewed an earlier Variance application <br /> which had been denied with prejudice and questioned if this was <br /> a substantially different application. <br /> Mr. Kirrane responded that the location is entirely <br /> different and it is now an expansion of a non--conforming <br /> structure . Steven Ball said he had approached the neighbor who <br /> objected without success at reaching an agreement . Mr. Friel <br /> stated that he felt the application was valid and Mr. Govoni <br /> agreed . Mr. Makunas moved that this was a new application and <br /> substantially different . Mr. Friel seconded . All agreed . <br />
